I used to be terrified in high school of getting pulled over late at night if I'd been at a party. Hell, I was terrified even if wasn't driving! The cops in our town were all ex-failed football players, total cowboy assholes. This was in the country sort of, Ft. Worth TX suburbs.
So, had a great little trick at parties: would grab a bottled or canned beer, pour it out in the bathroom, and fill it with water. Would then just act like a fool all night as if I were drunk. If I wasn't driving myself Id maybe have one or two beers, and water after that. I just never wanted to get pulled over and be nervous, scared, etc. Always hoped I'd get pulled over and asked if I had been drinking so I could half-sarcastically say "no, that's against the law, why would I be doing that?"

DUI laws are fucked. BAC levels arnt quite accurate descriptions to go by to see how well someone can function. Many factors can of ability and tolerances and body types can all function differently with different BAC levels. .15 used to be the standard where it may impair driving. But bitching and moaning groups get it dropped lower and lower and people are happy because it provides a revenue(politcians) and an illusion of safety(whiny bitchs). Lawyer up and try to get out of much damage as possible. Its your right to do so. Technically you didnt do any real damage, or did u? Its just a bullshit minority report preventative type law... Cant wait for the banning of all bluetooth cellphone headsets and phones in cars.

Pay a lawyer for some advice. Even if you don't end up taking them to court with you, an hour long consultation with someone who knows the law in your state is going to be a whole lot more valuable than an internet forum.

also, any half-assed lawyer would eat that cop alive in court. Breathalyzers are notoriously faulty, since you were so close to the limit, you have so many outs. A swing in temperature for instance could have pushed it over the limit.

Read through most of these responses and frankly I'm blown away. I do not support drunk driving but all the "You're lucky you didn't kill anyone" responses seem a bit extreme. The guy had 3 drinks in almost 2.5 hrs. Healthy livers clear out a drink an hour..... sounds to me like some shitty fucking luck w/ that breathalyzer test result. But maybe we don't know the whole story. Maybe he didn't eat anything for 24 hrs before having those drinks?

Both my brothers have multiple DUI's and found no way out of them... one went to jail - didn't drive for 3 years (still doesn't drive)... the other did minimal jail time and JUST got his license back after 2+ years...
... I guess my first bit of advice would be not to post it on QBN... but since you fucked that one up... my next bit of advice would be to LEARN YOUR FUCKING LESSON. You can't get out of this shit... read the previous posts in this thread - you're screwed for a matter of time... ... just wise-up, dude... that's about all you can get from this experience. (sucks... I know... but I'm surrounded by this shit and there's really nothing you can do but take your licks AND NOT DO IT AGAIN... ) :(

Seriously, why are people even bringing up weight, food and ethnicity as factors? That is why the BAC measurement is used. In fact BAC essentially DOES account for that. If your body manages alcohol better, your BAC accumulates more slowly.
There are a couple here who seem like they are trying to more convince themselves that a few drinks and driving is fine rather than anyone else.
