hand over 7 original home page concepts for a finished web site that didn't use any of them?
i signed the papers for this project in may 2005... FINALLY finished the project after the client finally stopped dragging their feet.
i'm freelancing to a small design shop downtown and it's there client. cause this project has been such a fuck i told them i would send all files, source code psds, flas and web files.
a month ago they asked if i could do 3 concept home pages for another client, i didn't have the time so i said no.
now they want the 7 concept home pages their client didn't choose along with the files i send over.
if normally i charge 200 per concept, that's 1400 they're going to screw me out on, as i know they want my 7 old concepts to use in upcoming projects they have.
that ain't right.... right?!?
and, i just realized one of the interns here has been talking to me for 25 minutes straight and i haven't said one word back. i honestly thought that was white noise. lord.
would you send the concepts?!?

I'd say something along the lines of "wow, that took quite a while for you to make-up your mind, there's a small fee for waiting that long, it's 1,400 plus a penalty of 300. It's documented within the contract."
They'll never look.

I'd sell them the comps but retain the rights to them. Say they're welcome to them but must licence them from you if they're going to be used in some sneaky fucker kind of way.

You should do what everyone is saying a sell them the right to use those comps.
You should also start charging them more per comp.

Those are good ideas, but I wouldn't move a muscle until you have a check. If they really need them, they'll pay up.

No doubt, get some sort of retainer. Money up front never hurts. Change your terms of payment if you can.

yeah, they just want my work to recycle and use in their upcoming projects.
i'm not sending them. if they want them they can pay for them. :)

helll no. i never do a per comp rate. it's so easy for the clients to screw me over on that. always hourly. even if i quote a project rate, i'd add if it exceed XX hours, then the hourly fee of $ XX will apply.
you can always say that you had an unfortunate accident of dead HD while backing up and the work is gone. no question asked.

i did this project for a flat fee. the fee was super good so i didn't charge for the comps.
normally, it's 3 comps, 1 round of revision to 1-2 comps. if needed, one more round of completely different comps but only 2.
this client was such a fuck they told me to go one direction, then, i didnt hear from them for 6 months. by that time they had hired a new salesguy who wanted something totally different.
3 more comps and he still wasn't happy. the dumb fuck pretty much wanted me to copy another site.
another comp using his specific input i said fuck-it and designed exactly what he wanted.
i even have the email saying basically if you get busted for 'borrowing' (as he put it) so much from your competitor, you're going down for it, not me.
anyways, the design shop i did the comps for wants all 7 of the unused one, cause they liked them so much. i know they're going to use them for future work.
no way.
they ain't getting them unless they want to pay for them.

did you sign a contract, and did it mention anything about what the final deliverable was? if i can work it, i usually retain all rights to unused comps/directions. some of my clients are work-for-hire, by which i mean that they have the rights to all work period (and in these cases i tend to charge a higher fee). lesson to everyone to make sure that this is worked out prior to starting development.

If it comes down to a pissing match with the design shop, try to work an arm wrestling challenge in there somewhere.
