Deciding if a lawyer is worth it is hard. Because it will be really expensive even for the simplest cases. You might be better off, financially, not using one.

The whole system seems flawed, do they take into account gender, weight and ethnicity?
an average sized european man can consume and tolerate much more alcohol than a european woman or say an asian male.

also, any half-assed lawyer would eat that cop alive in court. Breathalyzers are notoriously faulty, since you were so close to the limit, you have so many outs. A swing in temperature for instance could have pushed it over the limit.

Yea i realize the financial penalties are stiff. I definitely would rather not pay a lawyer to put a guilty plea in for me ... not looking for the easy way out either, just dont want to get raked over the coals for my poor judgement.

You may be able to get a diversion agreement. You have to qualify and the judge has to accept. That is your only true chance of getting this held off your record. The only downfall, if you fu*k up again you get this automatically charged plus whatever law your broke.

I rejoined because I can sorta help in this situation.
First things is: You're screwed.
•You will have about $3,000 in fines
•You will lose your license for a year
•Depending on the state you could have to partake in court mandated alcohol education classes. ($50 a class x 20 classes)
•Your auto insurance will go up significantly. $1200 a year to $3600 is typical.
•Possibly 100 hours of community service or morgue workOptions:
Stick with the public defender unless you really, really have money for a lawyer. He can help with the below and reduce finds
1. You can keep a license (restricted license) to drive 'to and from work' or 'to and from school' - A public defender should have no problem getting this accomplished. Especially if you have no record of criminal activity or drug use. This does not mean you can drive to the grocery store or an old designer friends house.
2. If your state does not require a court mandated alcohol education, offer to enroll in one out of good faith
3. Offer to do community service if not required by the court.
Your #1 goal should be to get a 'Restricted License' but I can assure you your insurance will go up significantly and you have to have full coverage.

how many times did you blow in to the device, a friend of mine had to blow more than once and for that the judge dissmised his case, he did get a lawyer and the cop dash cam helped his case , you are only suppose to blow once , either way he paid up the ying yang

Read through most of these responses and frankly I'm blown away. I do not support drunk driving but all the "You're lucky you didn't kill anyone" responses seem a bit extreme. The guy had 3 drinks in almost 2.5 hrs. Healthy livers clear out a drink an hour..... sounds to me like some shitty fucking luck w/ that breathalyzer test result. But maybe we don't know the whole story. Maybe he didn't eat anything for 24 hrs before having those drinks?

Did you take a B.A.C. test? That could make a difference in all this, no evidence can take it down to reckless driving, which in turn can be off your record if you keep it cool for a year or two.
Your main goal is to reduce the charges and try to keep that off your record.

Both my brothers have multiple DUI's and found no way out of them... one went to jail - didn't drive for 3 years (still doesn't drive)... the other did minimal jail time and JUST got his license back after 2+ years...
... I guess my first bit of advice would be not to post it on QBN... but since you fucked that one up... my next bit of advice would be to LEARN YOUR FUCKING LESSON. You can't get out of this shit... read the previous posts in this thread - you're screwed for a matter of time... ... just wise-up, dude... that's about all you can get from this experience. (sucks... I know... but I'm surrounded by this shit and there's really nothing you can do but take your licks AND NOT DO IT AGAIN... ) :(

You are fucked. I mean this is the nicest way. Depending on your city, DD laws are getting stiffer and stiffer.
There is no way out of it, no way to not pay for it, no way not to do the Community service. If the Officer didnt say the mythical "Hey, just get home and dont drive anymore" you are about to get the hammer.
Work your ass off now to save as much money as possible. You are about to get wiped out 4x over. Rather not paying for a lawyer is a mistake. Its stupid but the judge just seeing a lawyers face can show how remorseful and prepared you are. You should have rather not driven. Its new years, if your license is at stake, why put it in danger?

Seriously, why are people even bringing up weight, food and ethnicity as factors? That is why the BAC measurement is used. In fact BAC essentially DOES account for that. If your body manages alcohol better, your BAC accumulates more slowly.
There are a couple here who seem like they are trying to more convince themselves that a few drinks and driving is fine rather than anyone else.
