(Aug 1 07, 12:36)actually if you ever used rights manged or photographer, using images that being used commercial purposes, the owner of the building or people in the photographs must consent to it.
Like the London Eye, that is owned by British Airways. if you use a photo from a photographer or stock shop, (not personal shots) you must clear it with BA.
This is same as taking picutres of someone and using it. you are not allowed to do that. hence model release.
if everything was to be in public domain, i could take a picture of you use it for to sell products or service.
now if you are photographer for a magazine and your sole purpose use of that image is to show the picture it self and not selling the product or service, you are allowed to do so.

I wonder how it works if you licence an image on behalf of a client, then display your work, including that image, in your company portfolio?

People in public can be photographed legally without signing releases. There's all kinds of plain-view exceptions to that. Hence the paparazzi etc.

i agree that taking a photo of a billboard is not illegal, but i don't know about using said photo to sell your services...that is the grey area
i recommend to anyone who is not sure about it, to have two portfolio's
a public one, that you are sure of
and a password protected (nothing can get through) version by request, that can have whatever the crap you want in it
i don't do it that way, but i don't hardly ever have a site up anywayz

My personal theory on Getty is that they would do much better if they brought their prices down to something like $15-20 for an average low-res RF image. Charging $150 for a 72 dpi shot of some cheesy-looking people working in an office is ridiculous and simply invites piracy. Trying to track down and litigate against people who copyright infringe is simply not feasible, so the best way to stop piracy is to make it more convenient for people to legitimately pay for the product - they'll make up in volume what they lose per sale many times over. istockphoto is going gangbusters targeting the low end of the market, Getty should cover their ass and target the middle as well as the high end.
