Patent for Flash, Flex, Java, Ajax, and XAML

the patent is for online creation of rich media. say you created a flash app that lets a user create flash banner ads through a web browser, your little app would be in violation of this patent. that being said, i have a hard time believing that this company can enforce it. any half decent defense lawyer should be able to find prior art.

i don't know if you could use art as an argument if your specifically making something to sell?
It wont be that hard to enforce. they'll just build it into forthcoming versions of flash. but there's always a way round.

thats F'n gay, i would quit all internet production, im not going to pay some arsehole for this shite...especially since he is a rich F'r as it is...i cant believe they would grant such a patent to one guy, since im assuming that dozens of people developed "rich media" and then it became one large piece through the sharing of information...thats horseshite

seems kinda odd, I get it, if I create an application that will create/modify Rich Media then its pretty much covered under this patent. Its kinda like patenting an online wysiwyg for rich media. Seems a bit to broad to me

there's a patent for the concept of European Money. Everyone thought the dude was crazy, sort of like Monopoly money. Yet he now gets a % of each Eurobill that's printed.

They will probably bill Adobe/Macromedia and any other programs that produce the products which will in turn make the costs of the software go up. Like it's not already expensive as it is...

there are really grimey people that wait for companies to die out so that their patent expires and then they buy it up and sue people using it.

this won't go anywhere. the patent system allows you to apply for a patent. if the person reviewing the patent application at the patent office doesn't do his homework, an unwarrented pattent can be issued.
just because a patent is issued doesn't mean that it will hold up in court. if this company tries to enfoce this patent in court, then the company on the other end just has to show that there were others already doing this before the patent application was filed. this patent was filed in 2001, five years after FutureSplash came out... i'm sure someone should be able to find something with which to negate this patent.

I think we can all relax. Here's how it works. He has patented the technology behind the things, not the use of those things. You already paid a licensing fee for the software so no one is coming after you for using flash. When you buy a car, you don't have to pay royalties for the patents on the engine. This is an issue for companies like the ones mentioned in the article.

Is this like that deal where the use of plugin technology was patented and that guy stood to make like a trillion dollars.
