this won't go anywhere. the patent system allows you to apply for a patent. if the person reviewing the patent application at the patent office doesn't do his homework, an unwarrented pattent can be issued.
just because a patent is issued doesn't mean that it will hold up in court. if this company tries to enfoce this patent in court, then the company on the other end just has to show that there were others already doing this before the patent application was filed. this patent was filed in 2001, five years after FutureSplash came out... i'm sure someone should be able to find something with which to negate this patent.
