fuck him, take it down. I have had to pull this card before, and it works. Don't wait to long after you say that though, incase they figure out how to copy the site.

me:
Could you please send me a link to the forum where you have been told the site was over quoted? I am curious to see who is telling you this information. Did you/they take into account the fact that I worked an on-site job, and traveled to the client’s house? Or the fact that I was a consultant as well, helping to develop content for the site? Or the fact that I also created your logo and branding package which included business cards, a letterhead and envelopes? Different designers and developers will quote you different prices based on talent, availability, and awards/experience in the industry. I highly doubt that the people you spoke to on that form have any of what I just mentioned.

this guy is clearly a dick - I've had some trouble with so called friends lately - people are bad, never give them an inch, you need to keep that anger inside, let it fester and boil down till you can really let it go on someone who deserves it. That's the sensible thing to do...
- derek20050
i gave him 48 hrs. i will stick to that.
- kelpie0
decent response derek.
- derek20050
totally kelpie.
- mattyd0
good points, derek. screw him if he is someone you know and is with holding cash for on a discounted rate. a this point its all business for you.
did you make him sign a proposal? if so, puill the site until he pays. if not, pull the site anyways and claim its your work still since he hasnt paid for it.
- jpea0
not sure if it's diff in TO than the US, but he can't do shit about it. If there's no payment made, and you take down the site, he can threaten all he wants with no result. you WILL be in the right in a court of law. Same as repo'ing a car for non-payment.
- ********0
Can we see the site?
- derek20050
he says this too...

the whole shit in this whole mess is the fact that he gave me a minibike which i thought i was borrowing. THEN he tries to take it off what i owe him!!
that is the key to his shit.
- mattyd0
i agree with calling him and standing your ground. he is calling you a pussy.
better yet. ill call and pretend to be your attorney.
- derek20050
it all started when he called me up (in the middle of a date) and started yelling at me. he said i was trying to fuck him out of more money, so i wrote him this...
Hey Shereef,
As per our phone conversation earlier today, I would just like to clarify some points you made, to help get this ordeal sorted out as soon as possible. I CLEARLY remember based on our MSN conversation earlier this month that we decided that the bike would be given back to you, due to the fact that I did not want to have that included in our sales terms of the Reef Marketing Website, and I would receive the rest of my payment, $750.00.
As you had stated in the MSN conversation, you originally wanted to deduct the cost of the mini-bike off my remaining balance. I didn’t want to do that, as the bike was used, and had appeared to be in an accident, with the handlebars damaged. It was also not taken care of properly, with a gas mixture of 100% gas vs the 25:1 mixture that is required for small 2 stroke engines. You quoted the value of the bike in the region of $800 dollars in the MSN conversation, and then $400 on the phone, whereas the real value of the bike, with delivery is $348.30. ( http://www.giovannibikes.com/ ) The bike was given to be in a dilapidated state, which immediately devalues the bike. I can not estimate a price for the bike, but it would sure be less than $348.30.
As it stands in regards to payment, my normal practice is to charge clients 50% upfront, and 50% within 15 or 30 days on completion. I did not charge you a dime upfront, and allowed you a week to deliver the first payment, AFTER the site had already been completed and updated. I even accepted a payment of approximately 35% of the total $1150.00, rather than my standard 50%. It has now been over a month, and I have not seen the other 65% of my funds. My normal practice is to charge the client 15% on top of a late payment per month, until it is paid off, which I will also not be doing in this case. As of now, it is my word against yours. Even if you factor in the overpriced estimate of $400.00 for the bike, you would still owe me $350.
I would like to see $350 in my account in the next 48 hours. I have a business to run, bills to pay, and contractors to maintain and pay.
I did not agree to keep the bike as part of my payment. We can discuss this during the week, but I will need to have $350 in my account in the next 48 hours, or I will be forced to temporarily take your site down until my payment is received.
Shereef, I am not trying to fuck you out of money here, I just want the terms of the site to be fulfilled and everyone to be happy.
Sincerely,
Derek--

Derek, record the phone call. Tell him you are recording it at the beginning of the conversation. You will thank yourself for doing it later.
Don't call without recording. It's simple enough to do and there are a variety of home-made methods. Simplest way is to splice a phone cord into a head-phone jack and plug 1 end into the wall and the other into the mic port on your computer, then record.
- derek20050
he responds with this.
Derek,
As u seem to be not capable of having this conversation on a telephone for whatever reason i will reply to you by email.
I also clearly remember our Msn conservation, where you were upset about the value of the bike and concerned with its present state. The bike cost me 400$ and then 148.62 to decal, when given to you nothing had ever been wrong with it. Im not a mechanic and if you say you certain oil requirements are necessary ill take your word for it. You ended our conversation with me saying you had already ordered parts to the tune of 40$ and would rather keep the bike. Im sure you have MSN history and can prove that to yourself derek!
As far as your regular terms i paid you the first portion of payment the bike and 400$ well before you had come anywhere near completing this website. As far as im concerned you were paid close to 70% before the site was 50% done. I have also had the site quoted by numerous web designers from an internet forum i was directed too and have been told numeroulsy that i heavily overpaid for this site. I justified this with the fact that i thought i had someone i could trust who maintain it and keeping me on the cutting edge of the industry and for this i would be willing to pay more.
Now you are threatening my website and in turn my business, this is not a good idea derek i do not take threats kindly. I have only been reasonable with you if you take this step you will regret it derek. If you would like the remaining portion of your invoice withing the next forty eight hours then you need to pick up the phone and discuss this situation with me like a man. Im treating you within the rules of the marketing industry yet u are threatening me like you are some kind of bad ass remember who you are dealing with i think it makes alot more sense dealing with me as a friend instead of an enemy.
Sincerely
Shereef Shiaty
