it all started when he called me up (in the middle of a date) and started yelling at me. he said i was trying to fuck him out of more money, so i wrote him this...

    Hey Shereef,

As per our phone conversation earlier today, I would just like to clarify some points you made, to help get this ordeal sorted out as soon as possible. I CLEARLY remember based on our MSN conversation earlier this month that we decided that the bike would be given back to you, due to the fact that I did not want to have that included in our sales terms of the Reef Marketing Website, and I would receive the rest of my payment, $750.00.

As you had stated in the MSN conversation, you originally wanted to deduct the cost of the mini-bike off my remaining balance. I didn’t want to do that, as the bike was used, and had appeared to be in an accident, with the handlebars damaged. It was also not taken care of properly, with a gas mixture of 100% gas vs the 25:1 mixture that is required for small 2 stroke engines. You quoted the value of the bike in the region of $800 dollars in the MSN conversation, and then $400 on the phone, whereas the real value of the bike, with delivery is $348.30. ( http://www.giovannibikes.com/ ) The bike was given to be in a dilapidated state, which immediately devalues the bike. I can not estimate a price for the bike, but it would sure be less than $348.30.

As it stands in regards to payment, my normal practice is to charge clients 50% upfront, and 50% within 15 or 30 days on completion. I did not charge you a dime upfront, and allowed you a week to deliver the first payment, AFTER the site had already been completed and updated. I even accepted a payment of approximately 35% of the total $1150.00, rather than my standard 50%. It has now been over a month, and I have not seen the other 65% of my funds. My normal practice is to charge the client 15% on top of a late payment per month, until it is paid off, which I will also not be doing in this case. As of now, it is my word against yours. Even if you factor in the overpriced estimate of $400.00 for the bike, you would still owe me $350.

I would like to see $350 in my account in the next 48 hours. I have a business to run, bills to pay, and contractors to maintain and pay.

I did not agree to keep the bike as part of my payment. We can discuss this during the week, but I will need to have $350 in my account in the next 48 hours, or I will be forced to temporarily take your site down until my payment is received.

Shereef, I am not trying to fuck you out of money here, I just want the terms of the site to be fulfilled and everyone to be happy.

    Sincerely,
    Derek
