I prefer email correspondence, as it allows a digital paper trail of what is said, which clears up confusion over issues, such as the mini-bike, and dates of payment and project completion.
When I spoke to you on MSN, I was not on my MAC, so I did not have MSN history. If you have MSN history on your PC, I would be glad to see the transcript. On MSN, I had spoke to you about ordering the parts for the repair of the bike, which I decided I would not be doing, due to the fact that I would be giving the bike back to you. If I had decided to keep the bike as you seem to think, I would have already ordered the parts to fix it! You even specifically said that you thought having the bike back in a non-working condition would be beneficial, as no one would be able to ride it and get injured, and you would be using it as a mantelpiece/promotional item at your various events.

My bank statement shows the following information in regards to your $400.00 payment;
27 Jun 2005 WWW3RD PTY DEP-1080 400.00
This is 6 days after I sent you the email telling you the site was live. This proves that the site was almost fully done as of June 21st, with still no payment. You can easily confirm this with your email account and your bank statements.
If you would like to call the bike “payment”, the bike was an after-thought and I was unclear as to what we were doing in regards to the bike vs. value of payment. It was my understanding when you dropped me off at Jamie’s house with the bike, that I was keeping the bike on loan, and you would be requesting it back when needed, as a promotional item. The first time I heard about me paying for the bike out of my monies made on the Reef Website was during the MSN conversation.
I am also sorry to say your math is wrong. If I was paid 70% of the site’s total cost, I would have been paid $805.00. If you look into your bank records, you will see that you have only transferred $400.00 as of today.
Could you please send me a link to the forum where you have been told the site was over quoted? I am curious to see who is telling you this information. Did you/they take into account the fact that I worked an on-site job, and traveled to the client’s house? Or the fact that I was a consultant as well, helping to develop content for the site? Or the fact that I also created your logo and branding package which included business cards, a letterhead and envelopes? Different designers and developers will quote you different prices based on talent, availability, and awards/experience in the industry. I highly doubt that the people you spoke to on that form have any of what I just mentioned.
I have given you an amazing price for what I have delivered on. I would charge any normal client $3000.00 or more for what I have done for you.
I am also not threatening you. This is standard practice for sites that are not paid. I have dealt with situations like this before, and have had to use similar tactics, which are the industry norm.
If we can not come to an agreement regarding the bike, I would rather cash out the value of the bike to speed up my payment, than argue over this bike issue for weeks. Please take into consideration the fact that I was given the bike with broken handlebars, and a worn engine with improper fuel mixture, which ultimately caused me to take the engine apart and look into the price of ordering a new piston.

Send the bike back by courier. Send him a final invoice for immediate payment. Mention your lawyer will be in contact if the payment is not made by said time.
