So a family friend is dealing with her two idiot sons, who are 17 and 18, both have been involved in selling drugs and currently the 17 year old is weighing and selling drugs out of the house he lives in with his mother.
The mother knows this. She has walked in on him weighing pot and putting it into bags. My question is, is she at any legal risk of knowing this is going on in her house - basically housing a drug user/dealer - and not reporting it to the police?
She's pretty oblivious to some of what's going on around her; she thinks these sons are going to go to a regular university and just instantly clean up their act. They both dropped out of high school already for crying out loud. My mom and I were talking about it and were curious if she's criminally liable in any way for her minor son keeping drugs in the house with the intent to sell them.
Any thoughts?

Aiding and abetting?
- He's not really a felon, or criminal, yet...mg33
- possession with intent to sell.... and them some more shit... they are fucked.dconstrukt

No she's not. If anyone tried to blame her or include her in a case if he ever was charged they'd have to implicate her in the actual dealing of drugs or hiding evidence or evading the police directly.
- I think teenagers peddling dime bags out their bedroom is no need to worry ... dropping out of school is though********
- this won't happen but if police show up and she shows them her son and his room and she did her job********

I doubt it, it would be hard to prove that she knew about or was involved in it. Is a landlord responsible for one of their tenants selling weed?
- Good point. Thanks.mg33
- Actually yes, if it's proven they knew.glitchsbrew

If he got busted it would probably be on the street or at school, the fact he lives at home and his parents possibly know this is only a side issue and again would have to be connected to actual criminality not incidental knowledge.
- They should talk to them about it and if they really care they should call the cops and let them screw their kids lives up.********

If they live in California, he could get his medical card and go legit. Slangin' marijuana isn't going to net any huge profit margins unless you're moving pounds. Seeing as how possession is considered an infraction now (like a parking ticket), a progressive mom would help him get legal and help him grow and distribute to legit dispensaries.
just playin' devil's advocate.

So here's a question I have,
In WA where I live I saw an ad in the local paper for this site:
http://medicalmarijuanaseattle.c…Looks like your typical MMJ dispensary right? Only problem is that as far as I know, MMJ isn't legal here:)
- medical marijuana is legal in Washington State********
- Not like in CA though where you can sell it. Dispensaries aren't legal.********
- It seems like people are pushing the limits of what they can do:)********
- how does one obtain medical marijuana then? pharmacies possibly?********
- Nope, the law says that you are supposed to grow it yourself.********
- oh sweet ... sick people are supposed to learn to garden********
- like are they supposed to become a hydroponics expert and invest a few grand in growing tech? wtf********
- like people with cancer and chronic arthritis are expected to start a grow op just medicate themselves********
- I tried growing weed once and it was barely smokable.********
- medical marijuana is legal in Washington State

True story but when I was in highschool a friend of my mother's son was going to police school and while he was doing his work training he went through my room with my mother's knowledge and left a real charge note stating all the things I was "charged" for like possession of marijuana and drug paraphernalia and stolen property including a bowling ball I stole from a bowling ally.

Idk if the property they live in is under her name, but she could be held partially/wholly responsible; especially now that she knows.
- The mother could get in trouble with the 17 year old kid.kgvs72
- no again it would have to be proven the house was being used with her consent and inclusion in trafficking. obviously this isn't the case.********
- they might say... 'hey you as a mother must speak to him and not allow this at home and make sure this doesn't continue.'********
- Idk man I don't think cops are gonna be that nice. It is distributing, she knows about it,kgvs72
- Not up to cops though, depends if they have a case or not********
- Innocent until proven guilty MFer!:)********
- no she has nothing to do with it. they don't take this form of dealing seriously at all.********

I'd wager that depending on which state you're in, they could make it uncomfortable for her in charges that she'd have to fight (but could get dismissed) like conspiracy if they ever got the cops trying to bust them at the house. I doubt she'll get in trouble, but having drugs in California is a lot different than having drugs in a place like Oklahoma for instance. I had a friend get ARRESTED in Oklahoma for less than a dime bag after getting pulled over and having his car searched (searched on a hunch actually he wasn't drunk or high). That would never happen in California -- it's too much paperwork, total pain in the ass for the cops for nothing.
But if her sons aren't in school and have figured out a way to make money for themselves, it seems like they should be pedaling their wares out of their own apartment, eh? I know plenty of people who moved out of their parents house at 17/18 so they can live life how they want. Hopefully your family friend enforces some rules and get them to grow up one way or another. If anything, those kids will bring unsavory people into her house that would be willing to scope out the things she cares about and steal, break, or ruin it. If her sons show no respect to their home and their mother, you can't expect their friends and/or associates to either.
That being said, I know plenty of friends that currently deal weed and I don't think it's the worst thing a person could do. But they're all pretty grown up now, have a few other streams of legit revenue, keep their risk pretty low, and they're not bring their parents into it. Those boys should go to California and become legal growers or sellers if they're really serious about doing this for a living and think it's so cool. There's plenty of people who have made millions doing it legit and out in the open -- it really can be an honest living. At the very minimum they could work as a sales person at a Cali dispensary/pharmacy. You don't have to be very smart to do that. I think you just can't have a crazy criminal history.

"They both dropped out of high school already"
yeah, the school part must had been really hard for them as all you really have to do is show up. lol.

I don't know if the parents where charged, but the dog was surely punished.

they're just kids, let 'em smoke pot, you're supposed to take drugs and fuck up when you're young.
If they're still doing that shit in their thirties then there's a problem

Ideally, she'd be related to John Ashcroft, Bush's first Attorney General, whose nephews were caught with 72 pot plants and ended up with ... probation(!)

the problem is that they've dropped out of high school.
GAME OVER.

The kids were both good students and went off the deep end. Her oldest son has a felony at 18 for selling pot to a cop. You might remember me mentioning something about that last year. The problem is that the mom is delusional about their prospects in life. It's sad, but they're 17 and 18 and going nowhere. She still thinks they're gonna go to universities and just get in because she has the money for it. The oldest one has a GED but a felony record too - she thinks they're just going to straighten up over night.
- mg330
LOL - the oldest son even admitted to her that he breaks into houses during the day to steal and have money for food and gas!

that's fucked up.

They are old enough to sell drugs, so they must be old enough to get their own place.
what happened to parent being tough ?
