Lego has had its latest bid for trademark protection rejected after being challenged by a rival firm. Mega Bloks, "challenged the idea that functional shapes, such as a brick or any other "industrial design", were necessarily excluded from trademark protection."
This seems pretty nuts considering the lego brick is such an iconic shape. More info ... http://www.independent.co.uk/new…

My kid got some cheap knockoff Lego last year for his birthday (not from me btw), but he threw it out because it didn't match 100% with all the real Lego bricks, both in color and sharp. He was only 5 and already aware of quality of toys! Lego should worry too much, the brick is good for another 60 years or so.

Lego has been around for so long it really does not need trademark protection, it has buyer protection from kids and families.

Always thought this ad was fantastic - an instant association with the imagination.
Its hard to see something like this and not think about the iconicity of the lego brick. Its a recognisable as the coke bottle, if not more so. It just seems like a strange decision not to allow trademark, but I agree, they have longevity.

I am not clear exactly what this fight is over...trademark usually refers to a logo or tagline, right? It doesn't seem like a trademark would ever prevent a competitor from actually copying your product, that would be covered by a patent and those expire after a couple decades anyway.
So too bad Lego, long live MEGABLOKS!!!

^ A non-conventional trademark can be given to a shape which would protect your product. For instance Toblerone is protected in Europe. The Coke bottle was trademarked in 1977. I was reading the other day that even some scents have been given a ™ in the states.

Legos are the best! I look forward to buying my nephew a new slew of Starwars toys for his bday and xmas!! Kids have so much these days!
(last year I can do this, though, but I have to say I'd have been in heaven with the amount of lego toys out there when I was his age)
Oh, and as an architect, I do love their new series. Maybe I should get him one of those....makes me miss my basswood, museum board and chipboard models...:-(
