Where's my money???

    Hi guys, trying to cut a long story short, I started doing some freelance for a company back in October. All seemed to be going really well, we had agreed pricing on jobs etc, and I got on really well with the main person at the company who is a web developer. Problem is the company has yet to pay me for any of the work done since October.

    I would have done something sooner except the guy keeps getting me lots of other work from other clients that do pay. And I have to collaborate with the guy on a lot of the projects.

    Thing is some of the work I had done at the beginning for these guys was not formally covered by a contract. Im not sure if I should threaten legal action or just leave it as a lesson learned. I really need the money at the moment and it's been 6- months/ I have sent many e-mails and called the guy every few days about this. They just aren't taking it seriously. They say that until their customers pay them they can't pay me. I'm tempted to contact their customers directly and negotiate payment with them instead. AAARRrrggg what to do :-(

    Thats bullshit. Dont do any more work for them under any circumstances until you get paid, the more they need your services the more pressure they put on themselves to pay up.

    That "we pay you when we get paid" is a load of shit. You may never get paid dude.

    tend to agree with slappy. you need to out pressure on them. If you're doing other work and you're being paid for that though, can you afford to not do any more work for them? If not you may need to just ride this out while you have a "relationship" with them.
    They don't sound very honerable though - so may well be time to look for a new source of work.
    Bottom line is if you don't get paid for doing what you do you are either doing it as a hobby or not likely to stay in business for very long.
    You need to weigh up everything - including the on-going work.

    Do you have any sort of agreement about prices/project scope? Even if it's just emails agreeing to what you've described for the stuff not covered by a formal contract?

    If so, you should still have some sort of case for collecting your money through legal channels. It's always tough when they're giving you other work that is getting paid for though because you don't want to upset the applecart but you can't be expected to work for nothing either way.

    Are they local to you? If so, why not go down and speak to them face to face.

    If they're not taking you seriously though, you only really have the option of stopping working for them until they pay or taking a hit on what you're owed if it's not too much and making sure any other work is covered by a contract.

    Don't do ANYTHING for them until they pay (I mean ANYTHING). Keep hassling them, make sure they know your still there, if you don't, they'll forget about you and you'll fall even further down the list of peeps they owe money.

    If you're working in conjunction with them on some other projects for other clients... just put the squeeze on them, saying you'll provide the next delivery of 'stuff' once your account is bought up to date.

    Thanks for the advice all, I have just sent another e-mail with a refusal to do any more work until payment is received (fingers crossed).
