People who put a contract on your house and then back out 2 weeks later because they have changed their mind and want a single family home instead of a townhouse DESERVE TO BE KICKED IN THE FUCKING TEETH

wtf...
my friend sold her apt and the buyer decided to back off. she kept $100k deposit. the buyer tried to claim it back through the court but they ruled that deposit should and will be used to cover the loss.

Somthing similar happened to my dad just a few months ago... Buyer tried to back out of the deal mid-escrow, claiming "he could no longer afford the place". This was of course pure BS. The buyer was just trying to escape because the market was going down. He got a lawyer on their ass, and now the guy wound up buying the place.

Sherman - we already moved - to another part of Denver.
A little tip to anybody moving house - EVEN if you find your dreamhouse first - SELL the place you are currently in before you move...and avoid all the headache and stress I am currently experiencing when a strong sellers market goes tits-up and becomes a buyers market almost overnight...

i always thought to deposit goes to the seller when a buyer backs out. strange.

Sherman - that IS weird! You have a 6 month old and we have a 9 yr old...too funny. Actually he is the reason we moved - the neighborhood has one of the best schools in denver, is much more family oriented with parks, swimming pools and things like that. Funny how when you have a kid you stop doing things for yourself and start doing things for them.
Total stress right now...but I know we are doing the right thing. Even if we end up not getting as much for our old place, this move was the right thing to do at the right time.
But I'll be damned if I am ever doing it this way again!!!

heh - for sure Jamie!! Got to take the good with the bad I guess...and it's mostly all good right now..oh apart from the fact that my wife broke her hip last month and has a 9 month recovery process coming up. Yeah, so apart from getting fucked over on our old house, having to pay more mortgage for the new house because of rising interest rates, and my wife breaking her hip, I'd say things were pretty damn sweet.

house buyers should have the right to do whatever they want, and even like at any convenient store have a 30 day no question return policy. in case you live in the house and you change your mind 30 days after you have been living in there...

that sucks nic, sucks bad. although i must say, that is not a very well authored contract your broker drafted (and i have a feeling i know who this person is ;). tk and greyhood are 'correct'; that deposit should be yours for this exact reason unless;
- there is a kick-out clause in place
- you are contigently purchasing the next propertyi would def. recommend re-authoring that so that you can be farked like that again. buyers' market (like it is in DC now) or not, that is a poor situation for the seller (you).
