I just keep the sensitive projects out of the nav and email links to those pages. Or just do a pdf folio

I got the ax at my last job, basically we got a new Marketing Director (boss #3 in one year) at my crap in-house art department. He immediately pulled me off of the biggest project of the year and gave it to some buddies of his at a firm in Boston. Not 100% sure why I got fired, but it was probably because of the bad blood that ensued between me and my micro-managing, paranoid, ladder-climbing boss. neue_75_bold is right, it can be tough to get over the bitterness.
I made the mistake of not burning DVDs of my work before leaving. All they gave me after one year of solid work and 3 months of hassling them over phone & email was low-res PDFs. Hence the reason why my current portfolio is printed on 8.5 x 11 sheets instead of something larger.
After that I packed it up, headed out to MO where the family lives, and spent the next 4 months creating a self-promo campaign. When I wrote the copy for my website, I made sure to give credit to my buddies @ Numark, but not to my superiors who weren't designers anyway. Haven't had any problems yet. I say go for it and if they sue you, tell them you have ZERO livelihood without the portfolio.
All that to say I got a great job out here, and I now look back and see that getting fired was one of the best things that has ever happened to me. Plus I met my fiancee out here, which is quite a bonus for sure...good luck man. Get out before they show you the door.

great stories people, but it's a case of my status as my boss's third hand. Short of using me to jerk himself off, I'm pretty much doing a lot of the work here myself. The other guy who we employed couldn't handle the workload or work rate so we fired him in January and haven't replaced him since. Anyway, I'm moving on up and moving on out so say the M People.

Never look back.
I made the jump fairly recently too. Worked for a top ten UK agency for three years. Learnt a lot but it was the most miserable three years of my life.
Worked my ass off, late every night (midnight at least once a week) and weekends earning this tosser a fortune. I was promised a Senior position with the prospect of Director level in 3 years. Never materialised so I sacked it.
Best decision ever. Work life balance is worth a lot more than any design award.

Erm, and to answer your question. (the bitterness took over).
Legally speaking, most design contracts have a clause in it that states your right to retain a single hard copy of any work that you are solely responsible for, for your portfolio.
The difficult bit is asking for it. (So don't, steal it instead. not that I would or would ever condone such behaviour).
