dude, call a lawyer.
for a flash site, during comps... simply make the site dependent on a file with an absolute url to your site. easy. for html, no clue.
for anyone else reading this, the short of the story is get multiple sign offs with payments at each step. i break mine into thirds. works fine. no honest client will complain. once you get to know the client and they pay on time, you can forgo this on future jobs. BUT all first jobs with new clients... get the payments.
i got stuck once too but the second biggest accounting firm in my town. jerks.

post the site... i have even seen designers post notices about clients who don't pay.

today i called them and now suddenly when "my lawyer will be.." is spoken they start to say oh yeah the check is here. SO I got a check today for all the print work I did. As for web work, she basically said upyours I had to hire someone else. Florida is a great state- you can put a lien on there house. What does that mean -well the "client" is in the process of selling her home, when they go to sign the papers the lien against it shows up and the purchase cannot go thru without it being resolved. SO If she decides not to sell now then whenever she does 1 yr. 5 yrs. or 10 years from now I will get paid. Only I at this point have the ability to recoup my money before the property can be sold.
I assume this will be applicable in any state. Regardless of wether they are seling their home, you can put a lien on their primary resisdence and it stays on there until it is resolved.
More then anything its a freaking headache from hell to deal with
cheers! biatch!!!!!!!!!!!!

I was going to buy that house, actually, and now my considerably large family and I are out on the streets, and I am unable to complete the website for her.
Funny how things turn out, isn't it ?

Why didn't you get a deposit before starting work? And also, you should charge for every stage of the development...
For example:
30% to begin project
20% after design is accepted
50% after project is completedThen you will never loose money or time...
Good luck!

everyone here have been fucked over at one point by a client.
it's all trail and error.
I burned my fingers too once, but now it's 25% down before anything is done, 25% halfway and 50% when it is done.
No one have ever complained about it, because thats what they do with their clients too
good luck.

Be careful about cashing the check..your acceptance and cashing of it would possibly make it possible for the client to say to court/arbiter that you accepted payment for the work in full. Go to a lawyer and sue them for real. You cannot lose. Unless they agree to give you `100% of what the contract states dude..

It sounds like you have a very good case. At this point all the evidence points towards them taking your work. If they aren't responding and haven't given you any money, and they are stupid enough to leave traces of your work on there, then you can do whatever you feel is right for you. A friend of mine shut down a clients entire site taking all his work and deleting it from their server like you said, and they ended up paying him. At this point it just depends on how nice you want to be about it.

shut them down as hard as you can, if they get away with it, they will just do the same to someone 'else all over again
