I did not read each post here, but there is a official solution to this problem that will onyl cost you $60, Apple is not fond of advertising this solution, but i jsut did it myself (granted with a 3 year old ipod, but ir eally doe snot matter.)
Go in, and tell them taht the battery is not lasting the full ammount anymore, adn that you would like to take part in the battery replacement program for $60, they will give you new iPod of the same version you have. I promise!

My iPod Photo was bought in Australia in 2004, Dec 20th and fucked up just over a year later, I first called Apple to sort this on the 9th Jan 2006 and they (after sending them proof of purchase and a few pleading phone calls) granted me leniency and I got a brand new a few days later after sending it back to them. I was only 3 weeks over my warranty so if your girlfriends is that or less, you have a case!!! Also, I got my brother an iPod mini about 4 days after my one which also broke a few weeks ago and he also got a brand new one!
give it a go, I'm sure even up to one month over the warranty they would be ok about it.

Yeah, Apple retail stores will do you good favours, even if it is against policy. I recently broke my old ibook g3 for the 4th or 5th time, no applecare no guarentee, no nothing. Went back and complained alot, three days later they gave me a brand new g4 ibook with superdrive an all that...
Now name me one other manufacturer who would do that?

Go in there with another working iPod and get the extended warranty. Come back 20 minutes later with YOUR iPod and say it's b0rken and you want a replacement chop chop.

I love to live in the city where your apple stores do favors for you.
I dropped my powerbook about 2 years ago. it put a tiny dent in the corner. 6+ months later my screen went out and i figured that my apple care would cover it. nope because of the dent it supposedly voided my apple care...

I 'dropped' my old and slightly unreliable powerbook a few years ago and claimed a brand new 15" G4 one no problem on my insurance. Fuck Apple care, that's a rip off.

My Wife's iPod is nearly 5 years old. Our Son's is three. Our Daugter treats hers lilke crap...and has gone through 2 iPods in three years.

Thanks for all the suggestions - a few people who lurk actually sent me really helpful emails and it looks like it's gonnae get sorted after all - one way or another.
Bottom line - make enough of a fuss and people will give you what you want just so you stfu and piss off....
