So what, he recklessly used a vehicle and killed someone. Five years in prison is by no means harsh for DUI and killing someone.

I would like to see more details also... like how drunk this guy was, how rechlessly he was driving (was he tooling around like an asshole?). Keep in mind something equally important. His friend was wasted as well, and was drinking with the driver all night and still got in the car. Also the passanger, being drunk stuck his head/body out of the window of a speeding car (enough to be decapitated so I'd imagine he managed to get quite an amount out
).Is there such think as drunk passengering also? It's also law to wear your seatbelt. If he was strapped in, he would not have lost his head.
Not advocating drunk driving in anyway here I personally can't stand drunk drivers. And avoid getting in cars with them at all costs. But there are many things to consider here.

there's no doubt that both the driver and passenger shouldn't have gotten in the car. that's not up for debate as far as i'm concerned, what is, however, is how the driver remembered so many details, but conveniently left his friend in the car, but managed to make his way in the house to 'pass out'.
yeah, i'm not buying it.
and the guilty plea was a good call by this guys laywer.

Yeah leaving the decapitated body in the car is something else that doesnt make sense. Unless the guy seriously blacked out after seeing such a thing... I didnt read the part where he explained that.
I'm just saying what I think given the facts of the accident.

-----No. I'm saying if the victim's family requested leaniency, he certainly got that. I guess in some way you have to say - if the direct family of the victim can be willing enough to ask for light punishment for whatever personal reasons they have, who are we to say whether it's right or wrong that they do so?

if it weren't for the suspicious activity *after* the accident. had the driver called the police immediately after the accident. then i would just have given the guy the most severe drunk driving charges allowed by law, which is probably some jail time and community service. if it were an accident, the death of his friend would be a pretty severe punishment in itself.
