I can believe that people could be so wasted that they would be unaware of the circumstances.
A comedian talked about being smashed once and said:
Have you ever been so wasted that you looked at your cab fare and thought thats what time it was? "Holy shit, is it really 17:98..I'm really late!"

Jaline true... and I can't say I havent done equally stupid [Disney World Resorts] in my life. Actually I managed to puke inside a car once :(
What I'm getting at is that not everything is so black and white...
In the case of a DWI it's horrible cause the driver never has the intention of killing someone although the desicion to drive drunk might be seen as lack of concern for other life (knowing that getting in an accident is a good possibility) including the drivers life itself.
In this case, under the circumstances it doesnt make sense to pursue anything longer than the 5 years, I just feel it will bring more pain to an already painfull situation for all involved. As for the kid having to vomit, like i said, he also has to take some responseibility for the accident. He was drunk, got sick, and made a hasty and poor desicion to throw his head out the window.

feel bad for him some, but at the same time, choices we make can damn us in the end if we let them...and i really hate seeing drunk drivers...no regard for others...

Disagree. It doesn't make sense that he would remember his friend sticking his head out the window because he was feeling sick but didn't realize his head got cut off. Drove for 10 miles (he knew when it happened), getting out of his car walked into his house and passed out...Alot of detail for someone who didn't realize he killed his friend.
He'll probably be out in 3 years for killing someone. He should do more time.

Jaline - I know... but that's the only reasoning that I could imagine unless your saying he did it on purpose and didnt know what to do after? but that sounds a little impossible. Maybe he bugged out, blacked out, who knows... but that is strange.. the whole story is just sad.

passenger: ""
driver: oh i see how it is... you remind me of this girl i dated in high school... always talking her head off.
passenger: ""
driver: but lemme tell ya, that girl gave great head!
*car arrives at house*
driver: ok, well i'm going to head in... since you're not coming in, i take it your heading out tonight?

You have to take some things in to consideration, one being that his friend, who was drinking wth him at the bar that evening (and many evenings before) was aware of his state of mind when entering the car. Want to call it a homicide? Ok, then the deceased is an accomplice to his own death.
It's horrible what happened and I'm sure the punishment of losing a childhood friend in an accident like this is grueling enough with out the state locking you up to rot on top of it. Add to the fact that the families understand the circumstances and are pleading against a homicide charge and the answer is obvious I would think.
