Where I live in the South:
quit = no unemployment
fired = unemployment

kon_we have a clause in new york called at will employment. Either side can terminate at any time. Unless it is insubordination or you do anything of physical violence or destroy company property or something you can get unemployment.
Also the way that it happened if they were to terminate me within the next week they would already be too late because I had handed in my resignation and they accepted it but changed their minds and it would be considered legally without cause. If they were to terminate me immediately they would have come up with a cause statement.
That's what the lawyer told me and even at that point I could have fought it because they are not my superiors.

I apologized and I am the one that is still getting a good rec from this place.
Yes it could have been avoided I agree but it happened and I was trying to get out of this place anyway.

you brought up a very interesting point which I didn't think was true. I live in NY as well.here is what I found on the unemployment website.
Voluntary Quit and Misconduct You will be disqualified from receiving unemployment insurance if:
You quit a job without good cause; or
You quit a job due to marriage; or
You lost a job because of misconduct; and
You have not subsequently worked and earned five times your benefit rate.

that's exactly the point. I am quiting with cause in theory but in legal terms I am not. But once they accepted the resignation, termination would be ithout cause because it would have been because at that point they just "felt like it"
Either way I am cool with it I wanted out of this place anyway. And I have fabulous recommendations from my direct managers.
