OK so I was young and stupid and put about $1,500 worth of stuff on a credit card a while back.
Well my ass is po' now and I can't pay it. I've been summoned to court.
the question is what can they do to me? Can I go to jail?

they are take away your wages if you have job.
if you dont have the money, you could get your property taken away.
if you have nothing, yuo go to jail

don't feel bad. i had $11,000 once.
crying usually helps.

Damn, they took you to court? The only thing they did to me was send the bill collectors and slam my credit rating. I eventually settled for something like 60 cents to the dollar...
Good luck

I JUST LEARNED THIS STUFF BECAUSE I'M SUING SOMEONE THAT OWES ME MONEY:
they will have a judgment entered against you if you do not answer the summons.
once they have judgment they can do any of the following things:
-garnish your wages
-file an abstract of judgment which will not allow you to buy or sell property until the debt and all of it's interest is paid off.
-take all of the money out of your bank account
-garnish you spouses wages
-collect money that is owed to you by others
-take possession of your vehiclethese are all of the things i can think of right now. there are a lot of other things. of course i'm applying california law but if you're in the U.S. most likely any or all of the above can happen to you. you should consult an attorney or pay off the debt. but for sure you better answer. you do not want a judgment against you.

I've been through that road too many times to even care. I've had shouting matches with the collectors too. The summons are a scare tactic to try to get you to pay up. Don't worry about it. Just make a deal with them to pay little at a time.

Newstoday-the multipurpose website.
Thanks for the info LastOne. I wasn't going to answer the summons and pray it would disappear like the other creditors.
Let the begging begin.

no matter what you do. answer! if you don't you'll be sorry. yes, its a scare tactic but its serious. it's a court document and it was SERVED on you.
then make a payment arrangment. make sure every converstion is confirmed in writing that way you can prove to the judge that you're trying to make a comfortable arrangment. its not a big debt, they'll settle for half and waive interest and attorneys fees.
the legal interest rate in the state of CA is 10% per diem. so, if you have a $1,500 debt, you'll be accruing .41 a day. believe me, it will add up. if the other side enters a judgment against you, you will have to pay their costs for suing you, attorneys fees (which we all know are excessive), and daily interest, plus the principal amount of your debt.
good luck. email me if you have other questions man. ths sux.

WTF? For a pissy 1500 bucks? Shit, I had over 40K-50K debt after college and I was never summoned to court.
Where do you live?
Just call them, tell them you don't have a job, and you will pay what you can in installments.
I can't believe any creditor would pull a tactic like that over 1500 bucks.

LastOne
so all your issues are ok i presume?
- LastOne0
calling them wont dismiss your lawsuit though. you have to answer!
call them also, but answer.
- LastOne0
Dinky,
yes they are. things are so much fucken better. thanks for asking man. how goes it with you?
- futurebound0
I live in chicago. the exact amount is $1,336.57, and they are tacking on the legal cost of $300. So they want me to fork over $1636.57.
I guess times are tough for everyone.
Stupid credit!
If only Tyler Durden were real. He would help me.
I'll give them a call.

declare bankruptcy today!
- LastOne0
are they suing you for breach of contract? or common counts?
- futurebound0
See I've thought about that, BUT THAT COST MONEY THAT I DON"T HAVE!
I'll pull my "I'm a poor college student" bit and make some arrangements with them.
- futurebound0
Not sure. I looked at the exhibits they attached and one of them was the terms of use for the card. So I am assuming breach of contract? What's the difference?
