Is 5 pt type legible for print? I want to use to populate index page list

Well... Legible to me but I would recommended it.
Usually they're the fine prints at the bottom of the page.

Depends on the typeface and the printing quality/method.
But it should be ok.Also be aware of the difference between 'legibility' (whether it's possible to discern the characters of the font and the words they make up) and 'readability' (whether it is comfortable to read in general). For example 5pt helvetica might be legible in general but not particularly readable in long paragraphs.

3pt type - a lot off off-set presses have problems - i wouldnt go lower than 4pt

No index, nor any other text block should be in 5 pt. Unless you are determined to irritate the reader.

For consultative typography, yes. Like the ingredient list on food packaging etc.
Definitely use caps. Although, lowercase might be OK if it's black on white...
