Just because it's not in circulation, doesn't mean it's "dead."
Just because it may be dead, doesn't mean it's not protected.
Just because someone in an online forum says it might be okay, doesn't mean you won't be on the bad end of a nasty C&D letter.
The fact that you have the notion you should ask means you know it may be wrong. Follow this rule of thumb...unless you can pony up the money for IP consultation and/or court costs, if you think it may be wrong, then assume someone's waiting to drag you into court to prove you're wrong.
Or to put it another way...pick your battles when it comes to IP. Only seriously pursue the ideas you truly believe in, because you're going to need to dump money into it, whether it's to see if it's free and clear, or protecting it from others who may want to refurbish/update it for their own purposes.

Depends on how far from the original logo you intend to go. If you actually want something nice you'll probably move far enough away from the original to be fine.

Logo for a bank = no way.
Branding a new publishing company = no way in hell.
Tee shirt for your sister = they won't find out.

If you like it, use it as inspiration. Go and find another 50 ways houses and buildings have been used in branding and logos. Step back, consider what each piece says to you, then make something original.
