Just because it's not in circulation, doesn't mean it's "dead."
Just because it may be dead, doesn't mean it's not protected.
Just because someone in an online forum says it might be okay, doesn't mean you won't be on the bad end of a nasty C&D letter.
The fact that you have the notion you should ask means you know it may be wrong. Follow this rule of thumb...unless you can pony up the money for IP consultation and/or court costs, if you think it may be wrong, then assume someone's waiting to drag you into court to prove you're wrong.
Or to put it another way...pick your battles when it comes to IP. Only seriously pursue the ideas you truly believe in, because you're going to need to dump money into it, whether it's to see if it's free and clear, or protecting it from others who may want to refurbish/update it for their own purposes.
