Possible Copyright Infringement Advice

Um, they had something of mine on their site as well that I am not even representing on my website (in production now for a new portfolio).
I just called up and talked to someone and he was very understanding, and said he did not make the decisions on this stuff, his boss did. His boss is of course out of town until Tuesday of next week, but he sent his boss an email on my behalf asking that my piece be removed.
He kind of had this "I don't care" attitude, but hell, it sounds like he was just some dude working there who had no power of authority.
I would call and tell them to take it down. There's no point in bumrushing the issue. Just have it taken down and leave it at that. Life's too short to lose sleep over something like this. I get the idea they were going for, but it wasn't executed well.

If they don't take it down, you should find out who they're hosting with (if they're using a 3rd party) and file a complaint with them. Could work.

If he doesn't take it down, I hate to say it, but you're pretty well stuck. In reality, getting a court to order him to take it down will cost much more than getting it removed is worth.
This is the real world of copyright in the digital age. It's easy to rip people off, and not get caught. And if one does get caught, it's really too much bother for the wronged party to try to enforce.
I contend that copyright has been virtually eliminated by the internet. Just ask a musician.
Putting something on the internet is about the same as giving it away--regardless of the fine print.

Its quite likely that they just ripped a shit-load of sites and popped them up as examples of what could be done, in the hope that
1. they would get some interest from decent work, and
2. that no one would really discover it or tell them to get to fuck.

I just talked with them and they tried to explain that they weren't saying that they did the design blah blah blah but I cut them short and told them it was copyright infringement and I did not give them permission and to take it down. THe guy said he would take it down so I'll see if he does so. Still, that is so cheap. I wonder if these other artist's know how their work is being used. I only found out about it because of my stat counter.

You've indicated on your own website that you reserve all rights (in the footer) and have declared copyright. I should think that would be enough to ask a lawyer for a C&D order.

Is it infringement? Yes. Of course it is, they can't reproduce your work without your say so. You should contact them and tell them, politely but firmly, that they need to take it down from their website immediately.

You have absolutely every right - there's a heavy implication on their page that your site is their work.
Phone them up and get yourself taken right off there - give them a good telling off.

Hi guys
I am wondering what you all would think of this.A web design company is using a screenshot of my art website as an example of an artist’s website that they could design for you. They don’t say that they designed the site but they said it an example of a website design that you could look at for inspiration when you talk to them about designing your site.
I designed my website, and I was never contacted about giving permission about using my website as an ad for them.
Here is the page in question:
http://www.dreamcodesign.com/art…As you can see they use many other artist’s sites as part of an inspiration gallery. My site is the thumbnail on the bottom right (www.lynnetteshelley.com)
I know there are many sites where you can look at inspiration galleries of websites. I don't even mind them, I just don't like how, if someone doesn't read the fine print, it looks like their company designed my website for me and they are using my design to hawk their own "design" services.
Is this infringement? Do I have any rights to request my thumbnail be taken down? I did email them and ask them to remove it so we'll see if that resolves anything....
