If he doesn't take it down, I hate to say it, but you're pretty well stuck. In reality, getting a court to order him to take it down will cost much more than getting it removed is worth.
This is the real world of copyright in the digital age. It's easy to rip people off, and not get caught. And if one does get caught, it's really too much bother for the wronged party to try to enforce.
I contend that copyright has been virtually eliminated by the internet. Just ask a musician.
Putting something on the internet is about the same as giving it away--regardless of the fine print.
