It's theft!
1. Contact them and let them know
2. No response – contact their hosting providerin both cases, cite a reason that you might loose revenue as a result of what has happened – ground for suing

Totally a rip since the code still has your info in it, but besides that it's a stretch. Design-wise you really don't got much on them in my opinion.

Both of these sites are so badly designed that each of them should be FLAMED.

How where them able to steal the entire template? Ok for css/js's but what about phps?
- pillhead0
That just taken the piss.

Have you tried mailing them... or did it bounce? Dordogne!

Maybe you can trade for that stone Perigourdine!

Ahh leave the guy alone. He is just trying to sell some houses. I am sure your dev guy reskined a skin.

its no David Hampshire....
- zenmasterfoo0
design aside, I like the house...

Contact them and see where it goes... btw, don't take comments here too seriously, most of us are having shitty days too and this might be a good outlet instead of bitch slapping account executives...

I think it is worth pursuing because it involves your livelihood. However, it's also worth pursuing the matter in a professional way.
1 -> Find out whether this person knows that the site is based on your code.
2 -> Tell him/her that you feel that using your code without permission is wrong, because this is how you make your living.
3 -> Ask whether they understand your concern.
4 -> Reassure them that you don't want this to become a big deal.
5 -> Give him/her some options: e.g. they could replace the code or perhaps suggest a payment of a fee.

You've got good grounds to go after them, and you should defend your work. I would start with a congenial email, basically calling them on the theft, see if you can work it out.
If that doesn't work, then you've got a bit of an issue, as it doesn't appear as though the house is for sale through a listing agent, where you could move up the company. You may have to get a bit more creative: get the site some additional bad publicity on rip-off blogs.
The "good" news is that once the house is sold, the site is likely to come down.

Thanks for all the advice. I have read all your comments. Some were very useful and some where total shite.

the money/time involved in pursuing this - ask yourself is it really worth it ?
- showpony0

As Detritus says Its probably a bit harsh to go mental of the back of this. Probably just someone with 1 No Knowledge of coding and 2 Just a guy selling a house
LOL
- WeLoveNoise0
just a possibility....
