I say you talk to the guy, tell him you will buy him an alternative URL if he give you the .biz one.
If he is in the same city I am sure it going to be a pain for him too. If he is a dick after that than throw the book at him.

dude, let's go kick his ass!
It's one thing to mess with someone a plan ride away but if he's in your 'hood there's only one solution to this problem.

You could win a case against them easy. Provided you have copyrighted and trademarked your name. The case would be over in 5 minutes. Even if it's not trademarked, you would probably still win, but it would be more difficult.

if all else fails, http://www.nopattern.mexico is a viable option .....

I've been getting spammy emails recently about registrars in China "warning" me that "someone" is going to register my domain names, but with the .cn extension and offering me the opportunity to buy them first at "favourable prices" I lulz.

Trademark and trade dress seem much more important here than the domain name.

mstrpln - have u actually trademarked ur name ?
may be something in that- It doesn't have to be a registered trademark to have rights in the trademark.ribit
- he may have the rights to trade under that name tho meaning no other multimedia company can do so.WeLoveNoise

you guys are dumb.
.com and .biz are NOT the same url.
There is nothing you can do about that. How can he be running the same name as you? If your actual company name is registered in Canada you have ownership over it.
But that ownership doesn't extend to URL's.

if you own a trade mark you can cease & desist, otherwise...
- in Australia you can cease and desist without trademark if it is proven that its "affecting your business."_me_

A client I have has sent a complaint to ICANN before about something similar. Worth a shot anyway...
