agency.com did the skittles site:
"I can't tell you that Modernista's site was the impetus or a source of concept for that," said Riccardo Zane, president of Agency.com, New York. "There's a bunch of sites like Modernista. In fact, Modernista 'stole' their approach from stuff that predates them by five or six years. Guggenheim had a site that's a floating nav, a number of search engines in the early days had a floating connection. If you look at a site like Musicovery.com, it's a floating nav concept that accesses Pandora, iTunes, a bunch of stuff depending on what people and users are saying. And I can't say our idea's a pure play idea, either. It builds and steals from others."

"Alright so many people im’d me this morning claiming they have seen the next great big RIP. Skittles.com, they claimed Modernista! did this first. Well I gotta say I don’t think either of them are all that original and frankly both have one giant issue going on with them. They have one thing in common they look broken, imo neither of their ” models ” were that similar I disagree. But on a large monitor both of their creative is so small compared to the rest of the site when you land on it. In the case of skittles.com theirs a rather annoying pop up box asking if you want to leave the page. I clicked on it right? why the hell do I need to be sure about it enough to waste my time clicking on that tiny box saying I do agree to leave this site!?
So.. overall great idea imo, by adding Twitter to Skittles.com, but its poorly executed and no it is original ( at least in comparison to Modernista’s site ) to those that call rip. And what Modernista! did in the first place I don’t think is all that original because frames have been used similarly in the early 90s. Also Twitter is a whole new animal and its gaining a user base faster than just about anything. And frankly how is it a rip to place content not owned by you on your site, the background sites were not the creative property of Modernista! or Skittles... It’s rented space and not their creative so how can one claim a RIP.. But more importantly.. the future of Twitter...." Read more for the full post..
