zenmasterfoo - Similar situation to me, it's a friends boss, been nice as pie to each other for the past 5 months till I started to smell BS with the reasons why I wasn't getting paid. I watched as deadline after deadline past with excuse after excuse. I've got all the documentation I need, her agreeing to the work, agreeing to the price, signing it off, saying how happy she is with it all, saying it will be paid as soon as possible (over and over again), I've even got one where she says she'll pay me out of her own pocket so I reckon I'm in pretty good shape to go to court.
Good luck with you pal
- shite...what company is you client? now you have me worried. Mine is a start up too.zenmasterfoo

Its been said again and again. Never work without a down payment and get at least one milestone payment along the way. How many depends upon project scale.

----UPDATE----
For those who are interested (not many I know!)
I threatened the company with court end of Nov, which left them with a month to reply, they remained silent, and then a day before the deadline I got a cheque for the amount. They gave me a cheque before in August and it bounced so I was skeptical, I paid it in and it cleared over Christmas so I've finally been paid by the fuckers! After 7 months of chasing! Horay!
Anyway, so I took the website down in September seeing as they hadn't paid. They didn't say a word when it went down, not a squeek. Just got an email from the boss threatening me with legal action if it's not up in 24 hrs!!!! These are some grade A arseholes! I chase them for 7 months for my money, they were using my work the whole time, and the minute they finally pay for it they try and threaten me with their lawyer! Fuckers!
I'm going to tell them I can't do it until monday as my web developer is on holiday, 24 Hrs is not a realistic timescale! Any thoughts? Advice?

Careful about being too pushy in this economy. I've got a few clients that are having tough times, one in bankruptcy. Getting paid, whenever that might be (our lawyer estimates it could take a year) is the big goal.
I could take their site down, but that won't get me the cash (they owe for a touchscreen, animations, etc. a decent amount).
Other clients have negotiated ways to pay over time.
Goal is always to get your cash, and, ideally, not to burn bridges for whenever this economy comes back around.
Everybody is hurting, the more people work out creative ways to get things done, get paid, etc., the better for everyone.
- Fuck all this shit.thizzbobby
- You're a pussy, sir.thizzbobby
- We're talking about 10 Months you ignoramus. L2read. The economy wasnt fucked 10 months ago...sorry u fail.thizzbobby
- Actually, I beg-to-differ: the economy was indeed FUCKED 10 months ago. You are wrong on that one.craighooper

Update...
Under a week to go before the deadline passes for payment, not heard anything or seen any money enter my account from her direction. I'm getting a little nervous that the deadline is going to pass and I'm going to have to take it to court.
Should I email her and say something? If so... What?!? Maybe say that if the deadline is not met, we will place a holding page up on her site saying it is down due to non payment?
- Jimbo820
Well it's all done and dusted. The were arseholes to the end.
I replied to their emails saying that we could not access the server as the password had been changed and that 24 hrs was not realistic. I offered to put the site back up if they sent me the details. They responded by saying I was extremely lucky they were not suing me for damages, as they have lost out on revenue with no site, and that I had no right to take it down as it was their intellectual property. Truly clueless, astoundingly stupid. So I sent them the files and told them they could upload them or I could do it if they gave me the password. They're doing it themselves.
If I could name and shame them I would, but that wouldn't be a clever thing to do. I've learnt a lesson money can't buy.

Jimbo82 in your contract do you specify the terms that if the payment is not met in full on the date specified you have the right to take down the website.

get it up ASAP so you dont look like an asshole too
- Jimbo820
No, there was no specific 'contract', it was all friendly and nice at first, there was no small print. But after having gone through this I'll be sure to add small print in the future.
- Jimbo820
Exactly what I thought omj
- Jimbo820
Keep a professional tone with them, then when it does go to court you don't have to read out emails with swearing and bitching in, wouldn't look good!
Good luck 5timuli

Sorry, just realised how much I wrote. I'm angry, that's why.

30 days sounds like a delaying tactic to me

If it were me and I've been in a similar situation I would send a cease and desist letter. Basically, cease and desist using my logo/stationery/etc because you have no legal right to use it because you haven't paid for the license (ie your invoice)
I've got a copy of the letter that I used which was drawn up by a lawyer. Quite happy to email it to you if you like.

i dunno, i think you're perfectly OK being an asshole and making them wait an extra day or two. he's just trying to do to you what you did to them,.
- Jimbo820
I know, she's been delaying and delaying. I'm too nice, that's my problem, she's been taking advantage.
I got her to write it all down in an email for me so if it comes to court, that will be handy
- OhYeah0
Yes, I have... Clients want this and that and when it comes to pay they don't want to know. I get very pissed when people or clients try to fuck me off like that. I kept my part of the deal now keep yours!
I know what you are going through, so try this:
1) Talk directly to the CEO or top dog there, admin girls know jack shit about payments.
2) Call them one last time and say you want your payment or else tell them to see you in court.
3) While they are waiting for their court call, send them a Turkish Birthdaycake (http://www.urbandictionary.com... to let them know how you feel!Good luck man and don't give in!
