Careful about being too pushy in this economy. I've got a few clients that are having tough times, one in bankruptcy. Getting paid, whenever that might be (our lawyer estimates it could take a year) is the big goal.
I could take their site down, but that won't get me the cash (they owe for a touchscreen, animations, etc. a decent amount).
Other clients have negotiated ways to pay over time.
Goal is always to get your cash, and, ideally, not to burn bridges for whenever this economy comes back around.
Everybody is hurting, the more people work out creative ways to get things done, get paid, etc., the better for everyone.

Keep a professional tone with them, then when it does go to court you don't have to read out emails with swearing and bitching in, wouldn't look good!

I've been quite lucky in that most stuff is done verbally on trust and not ended up shitty. I think contracts depend upon how large/much the job is. Contracts on jobs that aren't relatively expensive are probably not really worth enforcing. I'd do email confirmations etc. Even so you still can't legislate for arseholes. I think you should name and shame as it's your perogative and your ordeal could save someone else a shitload of grief

Man this sounds like hell. You are lucky you got paid since there was no contract. But you should never take down the site before legal action!

No, there was no specific 'contract', it was all friendly and nice at first, there was no small print. But after having gone through this I'll be sure to add small print in the future.

Well it's all done and dusted. The were arseholes to the end.
I replied to their emails saying that we could not access the server as the password had been changed and that 24 hrs was not realistic. I offered to put the site back up if they sent me the details. They responded by saying I was extremely lucky they were not suing me for damages, as they have lost out on revenue with no site, and that I had no right to take it down as it was their intellectual property. Truly clueless, astoundingly stupid. So I sent them the files and told them they could upload them or I could do it if they gave me the password. They're doing it themselves.
If I could name and shame them I would, but that wouldn't be a clever thing to do. I've learnt a lesson money can't buy.

Thing is, when I took the site down they hadn't paid so therefore it was my intellectual property and not theirs. So I don't have to worry about that I think.
Now they've paid, the first email they send is threatening me with legal action if it's not done within 24 hrs. That's not realistic, especially when they sent me the email after 6pm.
I'm not going to lower myself to their cowboy level, I'm maintaining a professional approach and will tell them the website will be up by monday. Then I'll wirte them a belittling email to get it all of my chesticles (that ones for you scarabin_net!)

Update on mine: Got paid on Monday. Almost 10 months overdue.
I have to wonder Jimbo if they have a case against you. You might want to speak with an attorney before you do anything drastic like that. I'd consider it done and leave the site up fearing they'd chase me legally for capital lost.
It's one thing to be right, and a completely different thing to be vengeful. So be careful.

I disagree about getting the site back online. Fuck 'em. That was really shitty behavior they displayed making you work your ass off to get paid. It isn't like the relationship between you and the client is salvageable... I'd blow it off, not answer their calls or emails for a while. Maybe write some programming into the code that will allow you to use a specific URL to temporarily disable the site as you wish. Fuck 'em, man. Fuck 'em.

For those who are interested (not many I know!)
I threatened the company with court end of Nov, which left them with a month to reply, they remained silent, and then a day before the deadline I got a cheque for the amount. They gave me a cheque before in August and it bounced so I was skeptical, I paid it in and it cleared over Christmas so I've finally been paid by the fuckers! After 7 months of chasing! Horay!
Anyway, so I took the website down in September seeing as they hadn't paid. They didn't say a word when it went down, not a squeek. Just got an email from the boss threatening me with legal action if it's not up in 24 hrs!!!! These are some grade A arseholes! I chase them for 7 months for my money, they were using my work the whole time, and the minute they finally pay for it they try and threaten me with their lawyer! Fuckers!
I'm going to tell them I can't do it until monday as my web developer is on holiday, 24 Hrs is not a realistic timescale! Any thoughts? Advice?
