    dropped my brother off at the courthouse yesterday...

    ... he'll be in jail for 4 months this time around. :(

    His third DUI (yeah... he's a moron)... it was supposed to be eight months... somehow he wittled it down.

    .14 is pretty drunst. Here in california .08 is the legal limit --- which is sort of bullshit because a similar situation happened to me but I happened to get a really great lawyer. If it was up to me I would have gotten it pretty bad because I failed a breathalyser and blood test. But I was just at the legal limit (.08) because I drank one pint of beer (I'm kinda skinny and short-ish) which most people would assume they would not be anywhere near being drunk. But, when they pulled me over they made me wait almost 45 minutes for a car to come with the right working equipment so my lawyer could argue that my blood alcohol level had enough time to rise to that point and I would have never have been drunk going where I was going if they had just let me go on my way. In the end, I got off with a light wet reckless and they never suspended my license or anything & time served with my night in the slammer. Oh man -- I was also on a fucking date, too! So I was all glammed up with make up and 5 inch heels. Nothing sucks more than spending the night in jail with a cute dress on.

    But it was a total set up. They watch people leaving the bar, walk to their car in the lot across the street, follow them with the cop car headlights off and cause an almost fake accident and then pull you over for reckless driving if you almost hit a cop car trailing behind you with no lights on. wtf is up with cops and their sleazy tricks.

    Sorry dude, get a good lawyer. It's worth it. Mine cost me a good 5,000 but saved me a lot more I woulda lost not working. I was in the middle of a pretty heavty contract.

    • no. we were just sitting in the car with the cop car waiting for yet another one to come. Had i gone straight home and never got pulled over -- I wouldnt have been legally "drunk" behind the wheel.

      I basically got off on a technicality. But for small people 1 drink = enough to get rolled.

    Personally I think there should be a zero tolerance policy whereby you're not allowed any alcohol if you're going to drive. I think this would stop these kind of things happening, even though it could confuse things the morning after when you still have alcohol in your blood and are unsure whether it's safe to drive.

    It really is not worth the risk no matter how little you've had to drink. Take a parking fine or the expense of cab ride home instead of risking the your or someone's life.

    I don't know about other countries, but in Canada you could be charged for drunk driving if a cop finds you behind the wheel of a parked car while intoxicated.

    Happened to a good friend of mine after a night out. Luckily he fought it and got off.

    People, i think all the fascist cops indeed put you in a nice niche where u assume that only because the cops say so it must be illegal. To some extend it's kind of sad, but in court what counts is not what cops says or that you talk about both sides of the issues as many of you in your liberal way of thinking (that i share) are used to do.

    You state your side, and your side only and make sure to paint in in such a way that it's the only right side (i learned that when i was being "coached" by a cop on how to talk to a prosecutor after 2 muggers that stole some money from me got caught). Thus you don't buy (and for that matter how any sane person actually could is beyond my understanding) that sitting in the car drunk is equivalent to driving on the highway at 65mph, likewise don't buy that reparking the car is equivalent to driving drunk. If you go to court beliving that it is, you will loose. The reason there are courts is to figure out the rircumstances of the specific incident. Just because some high school drop out cop says it's illegal doesn't make it so.

    Thanks for your support guys.

    Could be months before it's even taken up in court the way our system works, but I'm still hopeful I will have answers to some of the stuff tomorrow when all the legal folks are back at work.

    For the record, I was not with my girl, but rather with an old ladyfriend with whom I have history. Not sure why I'm telling you all this, but I managed to lie prior to going out about who I was seeing because I can't deal with jealousy with someone having insane mood swings, and the fact that this particular girl is now the key witness made Mrs Jawks furious enough to bail for god knows how long (forever?). I think she's at her folks home or something and I'm stuck here alone with a few bottles of wine. At least I won't be doing any driving tonight ....

    A friend of mine was killed by a drunk driver that was only pulling his car out of the garage to wash it. So do the time and stop crying already, apparently you will still be alive, unlike all the innocent pedestrians that are killed every year by intoxicated drivers either drunk or high on drugs.

    I hope that you learned your lession and can move on with your life. I personally wish you the best Jawks and thanks for sharing your story.

    the truth is, and it's a whole different can of worms, that she did what lots of girls do which is put herself on the pedestal and in the spotlight. Instead of looking at the essence of the situation where the fact that you lied is an issue but nowhere as serious as her boy pottentialy going to jail she chose to care only about her own feelings and made the scene about how he liead and shit and then without helping the situation simply left to her moms... I don't know how to break it to you man, but have sex with her as much as you want but don't go into any serious relationship with her (and if you are in one -- she's not worth it... but there is the baby... man u r fucked!).

    unfortunate.

    Happened to me when I was 23. I pretty much stopped getting drunk after that. It was def. a low point. I got off extremely easy: the cop didn't show up to court and the DMV suspended me for a week. I was still out a couple grand for legal fees, tho.

    It was one of many hard lessons that brought me to faith in God. I don't regret a thing that happened, though I certainly had plenty to be sorry for and wouldn't wish some of my mistakes on anyone.
