Ok, so, I got rearended yesterday. I was stationary, and this lady plowed into the back of my car.
I am trying to prepare myself to deal with her insurance company, and I was hoping for some pointers. My wife drove me to the hospital after the accident and I got checked out. No broken bones, just muscle damage/pain. I am wondering what my plan of attack should be with the insurance company. I am not one of those people that just wants to fuck the insurance company out of money just to be greedy. I am in serious pain and I want to be compensated for it. I dont know what I should do or what I should expect in the way of a settlement from her insurance company.
Does anyone have any experience with this? Or any advice for me?
Any help would be seriously appreciated.

I took pictures of the car, and contacted my insurance company yesterday. I spoke with my agent today, and he said I would be dealing with the other ladies insurance company, not them. Should I ask him for advice too?

Many insurance companies are only motivated by the likelihood of you being a dick, so just make sure you push for what you want and don't soften up to the point where you can lose your standing.

you will be very sore in 2-3 days. an accident like that it takes your body some time to really show how banged up it is. her insurance company will contact you and ask you a bunch of questions. they will ask you if you hurt. say yes, even if you don't, trust me, you will. they might offer you money to 'settle'. think about it. if you take it that means you can NOT go after then later for more money.
i'd say your back in 2-3 days will feel like it got run over by a truck. you may have to get it checked out, which will cost you money, which you could have gotten from the ins company if you hadn't settled for whatever laughable amount they'll try and throw at you.
i took their $1000 offer when i got rearended and 3 days later i could hardly get out of bed. the doctors costs barely were covered. be careful.

Speaking of car accidents, there was a minor one on the street by my girlfriend's place this morning. I heard all the noise from 8 floors up, and it was a rear-ender where the car that got hit went up on the sidewalk and into a concrete building corner and INCHES FROM DRIVING RIGHT INTO A CASH ADVANCE STORE!!
The airbags deployed, it's -4 outside this morning, and the woman who got hit got out of her car and just wailed crying on all fours on the street beside her car. It was surreal.
While I'm sure it was a huge shock to her, you'd think the car was full of people that were killed instantly. I feel for her being scared like that, but the way she was carrying on you'd have expected her to narrowly escape a car engulfed in flames. I think the airbag totally freaked her out or somethning.

Also, NEVER talk to the other person's insurance company. YOUR insur. company or lawyer does that.

I am wondering if it is bad enough to get a lawyer? My airbag didnt deploy. It did knock me unconcious for about 10 seconds. I was totally fucked up. And, I dont have to wait 3 days before I hurt, I am in searing pain right now. I missed work yesterday, but I have a pitch to get out by the end of the day today, so I came in. I am all packed full of pain killers and wrapped up in thermacare pads.
Would a lawyer get me more for my pain? Would it be worth it? Has anyone here actually gotten a lawyer before?

I'm sorry but I think it is lame of you trying to make money from this. Did she do it on purpose? Did it incapacitated you seriously? You're not making living in society any better if you sue her for a sore muscle. Unless she was intoxicated and irresponsible, of course. At least give her a chance to reward you directly for your work losses if any exists, before you put a hound on her tail. Put yourself in her shoes, dude. I can happen to you next week.

Point taken. I totally agree that I shouldnt be looking to make money on the deal. But, I am looking at it this way: What is neck and back pain worth to me? Should I expect to just suck it up and deal with it? I am not at all looking to fuck someone out of a bunch of money just to "get rich". I just want reasonable compensation for my injury. I got rearended a couple years ago, and when it was all said and done, I came away with 200 bucks for all my pain. I was still hurting from that accident a year later. Was all that pain worth 200 bucks? No way. I should have been better compensated for that.
And, the lady hit me when I was stationary. I was waiting for my chance to turn left and she just nailed me. That is kind of negligent if you ask me. I dont know. Like I said, I am not being shady, I just dont want her insurance company to fuck me over. And, it isnt like I am putting a hound on her ass, I am putting one on her insurance companies ass.

Happened to me 3 times in 2 years living in LA. The first time i let it slide, I had a crappy car and I got the $ from her insurance. Second time was when I was on my way to see a car to replace the one that got scrapped. This time I went to see a laywer and got $10K plus medical.
Seriously, Its a very big inconvenience. Your car is messed up, you have to deal with repair shops, be out of a car for a period of time (unless they give you a rental), the value of your car is less because your car has been in a accident that involves body work. And your pain. All of this is worth something, at least to me. If it didnt happen you would have been on your merry way, but now you have a bunch of crap in your life to deal with, including physical pain. I saw sue.
- Also, why is your insurance involved? This has nothing to do with them, its her insurance and you/ your lawyer.mitee_
