I'm really playing devils advocate here - just looking to listen to other peoples opinions.
Of course it is still prudent to keep things like the menu and all important links/copy/etc above the fold...but as more and more people get used to scrolling, is it as rigid as it used to be?

Marketers and SEO people (not designers or other creatives) LOVE to throw that term around when they are giving their "input" about how everything in the promo needs to be big and at the top, above the fold.
I hate this temr almost as much as I hate use of the word "pop."
ex: "It needs to pop more."

at this point i think it's still safe to say that primary branding, navigation and at least some content should reside above the fold, especially regarding e-commerce
