So I made my application to some appts, I was accepted and gave my downpayment, payd the application all the same day.
I found another place that I like a little better so I called the first place and I told them I wasnt going to move back. I just wanted to get my downpayment back, I know application fees are non-refundable. They say they wont give the money back since the other appartment has been off the market for nearly 3 weeks.
Is this a normal behavior? Should I just considered my money lost? or is there a place where I can complain? besides the regular rateappartment.com thing.

ask them to show you in writing how they are allowed to keep that money.

yeah, defenately I want to be polite, that is why Im trying to figure things out and not just tell them that they HAVE TO give me my money back.

i was in a fairly similar situation once. They told me that because i signed the lease, if they can rent that apartment out by a certain date, then I am released from the lease but i lose a percentage of the money.
Good Luck with this. I'm sure it's annoying.

In your "riding" or "area" is there an elected member that you can ask for help. They're always willing to help - just to get a vote.

No, I didnt sign the lease, and that was my first comment. but they said that since the appartment was off the market for 3 weeks they couldnt do anything.
The appartment is even still occupied by some one and wont be available until the end of the month.
I understand their position but if we examin the situation
1. I didnt sign a contract
2. Its in the city its not like the appartment is never going to get rented
3. the place is occupied, its not like they are loosing money by waiting for meanyways, like some one said, its just annoying. grrrrrr

here's what you need.
a large flathead screwdriver
a "new friend" that thinks your name is Albert. (tip - Hang out in front of a comicbook store. Tons of people there that need friends... human friends that is)
2 pairs of latex gloves.
1 16 ounce beer (aka a "tallboy")
____Ok so you've met a dude at the comicbook store. Be all buddy-buddy with him for a couple of days (make this a monday so you won't have to hang out with him during the weekend. that could surely suck.) Don't get too close with him because he will soon be going to prison. While you're hanging out make up something silly about latex gloves. Put on a pair and THEN hand him a pair (that you've never touched with your barehands). He'll put them on because he thinks your cool (because you smoke cigarettes , smell of beer at 9 in the morning and you know the names of obscure rock bands). Keep your gloves on until he removes his and then take his pair and put them in a clean ziploc bag. The next day ask your new friend if he can give you a ride to the crooked landlords office. He'll say "sure thing Albert. anything for my bud." Put on a clean pair of latex gloves. Put the ziploc bag with his gloves in one pocket. put the screwdriver in the other. Ask him to wait in the car, go into the office and stab the offending landlord with the screwdriver. Dump the dude's gloves out on the floor along with the screwdriver. (i saw on CSI last night that they can get finger prints off of the inside of latex gloves). Walk back out to the car real cool like and ask your bud to drop you off at home. Feel better? Have a beer and call in an anoymous tip. Tell them to check the comicbook store.

Yeah, i thought of that too. I drove to their offices a week and a half ago, to find out they were closed at 5(i got there at 5:30). I put it off until today and guess what! no more money!I guess in the end its my fault, Im still going to try to get some back if I can.
