Question 7.
Ted was a man of 77 who lived on his own. He suffered from painful arthritis and this made him rather short tempered. Ted frequently became annoyed with children playing outside his house and sometimes they teased him and called him names. One day, children outside the house were making a lot of noise. Ted went outside, waved his walking stick and told them that if they did not shut up they would get a dose of his stick. Some of the children laughed at him and one of them said: “You couldn’t catch us on those wonky legs”. The children then ran off but Ted stayed outside his house. Five minutes later, Walter (aged 12) came skateboarding down the road. Walter was not one of the children who had been outside the house earlier. Walter was unable to control his skateboard and crashed into Ted, knocking him off balance. As Ted fell, he lashed out with his stick, shouting: “I warned you!”. Walter was hit on the head. Because of an unusual condition from which he suffered, the blow caused internal bleeding in the brain from which he died.
Discuss the potential criminal liability of Ted.
Answer:
Walter deserved to die because he demonstrated an inability to make the 'right' choices in life by riding a skateboard. If Ted had not lashed out and ended Walters life at an early stage Walter would have certainly grown up to be a human trafficker, drugs baron or possibly even a freelance web designer. Ted should not face any charges as a result of exercising his right to carry out "Juvenile Abortion" under the US constitution amendment 666. sub clause heading "Community selection".

not like here....that same situation in england would have resulted in nothing more than a telling off...and quite possible a stern 'piss off out of it'. I certainly wouldn't have been treated like the common criminal I am being made to feel!

is the owner of the property the one being the asshole, or is it the muni courts?

les courts...I am beginning to wonder if it would help writing a letter and pleading my case to the owner...except it was some caretaker who filied the trespass charge so I don't know if it will help doing that. it jsut weighs so heavy...it makes me sick to think about it and it's completely depressing me. I love it here and don;t want to have to leave. I can;t believe something so silly would even come to a trial. I wish I could jsut plead guilty - pay the $150 fine and be done - but I can;t have a misdemeanour charge on my record or I get booted...which is why I'm fighting

no such luck...I don't get citizen status for about 3 more years. At the moment I am a 'resident alien'.
