what do you guys do when a client doesnt pay you? do you go as far as filing a lawsuit?

yes but legal cost exceeded the invoice...
if its for small claims court, you can represent your self..
what i would do is that, if you have the contract and invoice, send it to collection agency..
yuo should give them 60 days (from the invoice date) with written warning plus verbal warning...
before you send it to collection agency, send them a letter saying that you are saying unless they pay in 1 week...
and tell them that you will pick up the cheque.. DONT TRUST THE MAIL excuse..

You have to call them every day and make them hate the sight and sound of you, yes it's a fuckin pain but sometimes you just have to push it. However don't be rude or angry just be persistant.

a friend of mine used to send over a sweaty smelly courier he knew to sit in the lobby of the agency until they cut a check, you could try that route...

cant they kick the courier off the property?
what if they just refuse to pay and they say, sue me! will small claims only enter a judgement then i have to collect it? or will the court? and plus isn't small claims under like 1k damages?
a collection agency is a good idea. do you guys know of any in LA?

A client wouldn't pay me recently. He wanted the source files for the work I was doing for him and I refused to give them over. That's the first thing you can do. Problem there is he can always get some hack to mimic the stuff you've done so far. ( like say, if you put up some jpegs or pdf's for him to look at...)
I ended up calling my cousin who is an attorney. Most important thing is to save every email if you didn't do a contract. Don't only print them out but save them on your machine. Every one from when you were approached to when you were activated as his designer. They ARE admissible sometimes. (trust me, it works in kiddie-porn cases..)
My cousin sent him a letter from his law office basically summing up how much his bill would be including his fees. Dude payed up quick. It may have not held up in court but it is an option. Find friend who is a law office intern or a paralegal and try sending an email or letter.

i say go for the collection agency route
even with court judgement, you still have to collect it yuor self..

Call the accounting dept and tell them that they need to pay some or all that they owe you as your financial situation is deteriorating and non payment could lead to your being bankrupt or homeless. Don't let them push you away. Tell them, don't ask, that you will be coming by the office at 1pm tommorow and hope they have a cheque for you.
Go there and wait, dress scruffy and scratch your head a lot, they'll soon want rid of you.

get all of your documents together and call a lawyer. or, get in touch with one from a friend of a freind. damn man, your in LA there are like 10 lawyers for every person there... someone has to know one. sometimes just the sound of "hello, my name is so and so and i'm representing mr so and so for the blah blah blah" can scare them into paying.
or just follow him home, and slash his tires during the night.

Get a posse together, if you have to, pay 'em to join you. Then go wait outside their office. Make sure the posse looks busy, baseball bat practive, window smashing...etc
You could go via the legal way but let's face it, it's a load of red tape and you know they got the cash. Quick side note, if the judge is french don't bother, you won't see yer money for years...
As you wait outside (with posse) they'll probably say that the 'checks in the post' and use any delay tactic possible but do not falter...make sure they understand that 'serious consequences' will insue should they not co-operate...
...i'm not too sure how it ends yet but something/someone will give in.

i do need to find a lawyer/paralegal friend to send them a letter. id be scared.
i do have a contract, they have failed to comply with the terms. i have a log of the timews that i have called them to try to get my cash and i have copies of checks that they have made out to me previously. those checks contain their bank account info. cant the judge order to just take the money out of the account?
i dont know about hanging around looking all scruffy. these guys are pretty scruffy their damn selves!
