i think OSHA supercedes the states' legislation unless you're a state employee. And they generally have pretty powerful unions that do allright for themselves, i highly doubt anyone's working without a 15 minute coffee break every 2 hours.

Employers act under guidelines set out by the government though. They'll get away with what they can within the law. I think it's this country, not just the state. People are treated like fucking shit here (speaking from outside experience).

I have found throughout my 11 years in the labor force that generally speaking, the people who complain about breaks are the ones not working hard enough to begin with. Or the ones who need a smoke break after every task no matter how menial or significant it was. Or... the list goes on.
Some people, on the other hand, like to work and know when they've 'earned' a break.

It's not the breaks I'm worried about, I work roughly 9-6 with an hour for lunch. In fact, it's not really the employer either, it's the North American work ethic. Working more than your weekly 40 hours is normal and expected, not just in this industry but in general. It's just wrong and makes people less productive and miserable, work, pay bills, work, pay bills.
