Thx

"Used with permission."
Of course, you'll need to get permission first.

None. If you didn't write or publish it, or licence it. You're possibly better off just either not saying anything and hoping the publisher doesn't take offence (which they possibly won't). Or just credit what the track is and who the artist is - kind of the way perhaps a youtube clip works. At the end of the day if the copyright owner finds out and doesn't like it, there's nothing you can do if they ask you to take it down.

it can be considered "fair use" or "fair dealing" for a personal reel or even a studio's. its not as if you are selling the video or using it in a strickly commercial scenario. promoting your own work to potential clients is NOT a commercial use it would be if you were using the music in a trailer for a film or something that is subsequently a commercial production.
Really the worst that could ever happen is the rights holder sends a cease and desist, your response can be to tell them its fair use and they should appreciate the exposure and creative application of the song or just be polite and cooperate. like 99.8% of the time they will not take issue because its a common and FAIR practice again so long as its just a promotional reel.
- Promoting your work to clients is not commercial use? It's very much commercial use.********
- incorrect. the reel is not a commercial product and there is no competitive nature to its use.uuuuuu
- how sure are you about it not being falling on the legal side of 'commercial use' exactly?Miguex
- Not intuitively speaking, but STRICTLY LEGAL speakingMiguex
- its not commercial because its not being sold, its just being used in a reel.uuuuuu
- its basically a creative and personal application not a commercial oneuuuuuu
- its also not being used to sell the content of the video just the service that the studio is offering.uuuuuu
- a film company for example couldn't technically use a track without permission in a reel of their films they are trying to sell to a distributoruuuuuu
- ...to a distributor or at the start of their movies. LIke "hey check out our awesome movies...!"uuuuuu
- thats a commercial use. arguably if they just used it once for a presentation or on a private promo disc its fair thoughuuuuuu
- So, if I'm a plumber, can I put any song in my commercial? I'm not selling the commerical, or the song. Just my plumbing services.********
- services. My future plumbing services.********

I think you can reuse a certain amount of notes from a song legally. Make a short sample a loop it. Or perhaps you can have someone else do a cover song. Many people do cover songs without paying any royalties. DJs are constantly doing mashups and making them available online. But the truth is that anything and everything is illegal, as long as there is a lawyer who sees that he can make money. So as long as you're not actually profiting from sales. They cannot sue you for any money, and at most can send you a cease and desist.
- its a complete myth that this sort of use is "illegal". Fair use laws are real laws are a big factor hereuuuuuu
- i think Disney proved that fair use is a joke by making public domain illegal for others to use.********
- public domain has nothing to do with fair use and Disney is just an obnoxious corp. with no respect for copyright lawsuuuuuu
- referring to the old mickey which should have been public domain, but now protected under Disney's lawyers********
- they haven't changed anything in copyright laws they just use a lot of legal pressure to control their own contentuuuuuu
- fair use falls within the boundaries of public domain, and are related.********
- is all i'm saying.********
- but what use is a law, if it can simply be torn down by someone with money and lawyers.********
- not really fair use is about using copyrighted material fairly and legally. public domain is about material that has had copyright vanquished though time or appropriationuuuuuu
- has had its copyright vanquished through time or appropriation.uuuuuu
- yes, but they can also overlap********
- within intellectual property rights********
- fact is... if a lawyer wants to make a case to turn a profit, they can.********
- this is an entirely other complicated issue. fair use is nevertheless still upheld in court.uuuuuu
- i wonder what Shepard Fairey says about that.********
- the obama poster if thats what you are referring to is again complicated and they reached a deal.uuuuuu
- if i remember correctly they settled without any judgement on its fair use.uuuuuu

youtube removes stuff like this a lot but they are not considering actual legal fair use practices they just go with the copyright bots and/or a complaint. it does not mean you can't do this legally just that video sites like youtube are bent towards copyright holders not actual fair use laws.

short answer is USE IT. Don't ask permission just use it fairly. In other words don't pretend you made it and don't sell it. Just use it to make the reel awesome.

This is one of those areas where legality and common sense part ways. If you are worried, get permission to ease your mind. Yes, you are infringing on copyrights, but if you are caught it's a safe bet you are only going to get a strongly worded email to take it down.
- i'm not getting in to it too much but fair use is not infringement. its a fair and legit use.uuuuuu

Thanks for your comments. It's a complex subject and I wanna be sure.
