If the penalty is huge, like $500k, I can imagine it unlikely that a judge and jury will convict an average person who does this for average reasons.... maybe only somebody who is trying to do something really bold, not just say making an AT&T phone work on T-Mobile....

I would reasonably consider wanting to use your Galaxy Half-Breed™ or whatever phone you'll have next on a different carrier is certainly doing so willfully, but not the accompanying AND clause of doing so for commercial or private financial gain - you're gaining, nor attempting to gain anything other than phone service - a commercial transaction in which you purposefully set out to lose money, in exchange for services. Fuck them, do it.
