Business Partnership Agreement

    I'm hoping someone can enlighten me on this since my knowledge in creating a business partnership is very limited to what I have looked up on the internet.

    I am in the works on starting out a freelance graphic design business partnership with another person. I am in the middle of drafting up a contract but as usual, I'm confused about the governing countries/state/province I would need to put in the contract since we are both citizens of different countries. We also don't have a home base since we dictate all of our work and communication online. How do I go about in solidifying a governing country in the contract?

    Also, if anyone have any websites pertaining to graphic design partnerships, such as advice, what to include in the contract, etc. that would be great!

    interesting one. I had to go through this also. (not with another designer though)
    one thing that is worth thinking about is is this partnership something you will grow into a business? or are you both just going to carry on being graphic designers? If you're just 2 designers that work together there isn't much need for a partnership, just a list of agreements you have between each other. who retains the rights to the work etc. you won't have assets or anything you can sell.

    however if you're going to turn it into a business then it's worth planing for the future before you start. i wish i'd read the e-myth a long time ago.

    I believe that we're going down the business route. The bigger picture or end point for us, if it will make it easier to define what we are, is that we plan to become a full-functioning studio with a small team comprising of 5-8 people on or offline.

    But you're right, I am trying to avoid the pitfalls between partners by accounting for all the possibilities of what this business can become in the future.

    OK, read the e-myth (just my opinion) but i thought it was a great book on how not to think about business. especially being a creative it's easy for the lines to get blurred and you just end up with a job. only it's worse than a job, because you can't take a holiday, EVER.

    Plan now, you can always change later, but by having a goal set now, you'll find it easier to write your partnership agreement.

    • Yeah, I'm starting to think that perhaps I'm making it more complicated than it really needs to be. I think I would just need to define who owns the work since we're doing 50/50 of the work. Thanks!dashofpower
