Also, to play devil's advocate, someone who had never heard 'National Anthem' could have made that, it's alternating notes on an already very limited instrument with a very popular form of ambient instrumentation and noise overtop. Wouldn't hold up in court at all.

there's musicians out there who specialize in making songs that sound exactly like popular songs that someone wants to be put in an ad. happens constantly, they just make something similar rather than paying for the original.
