i hired a freelance developer (who many of you know here) who assured me that even with some contingency time a project would take 3 weeks to complete... its now 4 weeks past deadline and ive still not seen any progress and my patience is worn out!
anyone got any tips on how to deal with this as ive already paid him 50% in good faith?
I prompted him again last week about my concerns that he hasnt asked for any payment service provider details and other information (FFS its been 7 weeks now and i'd have expected this to be in my first set of correspondance with him but i decided to let him lead the development process as i didnt want to cramp his style) and hes only just asked for it.
i asked him weeks ago to keep talking to me and send regular emails but i get sweet FA from him...

Well if you're missing your deadline for your client, I'd be looking to find a decent developer to get the job done ASAP

I have met many developers who fit this bill, a lot of arrogance and unprofessionalism in that area (not all of course)... The problem I have found with some developers is that they live in a bubble and have little regard for the business side of things , i.e. deadlines etc... Not good - I feel for you.

I'd not bother messing around with him if he's that bad. Work out the cost to you/your client of missing deadline etc and tell him you'll be submitting it to small claims court if he doesn't pull his finger out of his arse and get going.

Painful as it may be I would suggest breaking down the tasks you feel are needed to complete the job into small and manageable chunks. Give your list to the developer with specific deadlines, so for example navigation completed - Friday 12 March. Explain that failure to meet the specific deadline is likely to result in you taking further action to get your money back and also that you will then hire a new developer which you will cross charge back to him.
Give them an opportunity (24 hours) to modify the deadlines by agreement.
Try to work it out together. By breaking things down (work you shouldn't have to do, but it may help . . .) you can both be clear when things aren't going according to plan and that will give them an opportunity to explain and you a reason to complain.
I think a clear task list can sometimes make people work with more focus. If I get a finish project by end of month request I'm likely to be less concerned than if I have a list of tasks that spread themselves over the days.
It may not help you, but I'm thinking that communication is more important to complete the project than everyone threatening various legal routes.
Outsourcing to people who you can't at least arrange a meeting with is obviously more complex than many people would admit. Could you propose a video conference call just to set the agenda for completing the work?

I do have the feeling online freelancers & agencies take a very flexibel approach to deadlines & corrections. Had some experiences with this but in the end everything turned out good.

all along ive taken the approach that ive been in his position before and wanted to give him the time he needs to do the work properly, but i feel my leniency has been taken advantage of.

developers arrogance all stems from the days when they had designers over a barrel, not so true anymore - I do my own CMS with wordpress etc - so only need to use them on more complex projects - phew! good luck

i haven't worked with anyone here yet, but my personal preference is to work on something small for someone first as it's a two-way street. yeah, developers can be aloof, overload themselves with too much work, and are notorious for missing deadlines (seriously, i've been in this biz for over a decade and i rarely hit my expected comletion dates - these estimations are a black art), but i've also had experiences where my project requirements are little to none. no specs, no documented workflows - actually, no documentation at all, no comps until last minute and then once the project does get underway, there's always the feature creep to contend with.
i stand behind my work and if my first small job doesn't meet the customers (that's you) expectations, then i don't expect a dime - but i also won't be working for you again, so no losses ;)
this is a competitive business, so i ask when someone does some good work for you, please rep/plug them here.
and mr. trooperbill, good luck with whoever this is - hope it all works out. but in the meantime i'd find someone a bit more competent for the job.
