I think its a grey area. to batesole someone else's illustration, sure. to copy a photo of one of the dolls, say, on a swing and use that, that's plagiarism.
But to copy the face of a three dimsnsional doll and use that in an illustration? Is that reallt such sacrilege? Jeez do we have to do EVERYTHING from scratch without even being influenced by others???

Thats different, these are copywrited characters. look at like you use the stuffed animals from 'Friends with you' and draw them almost exactly the same & then ask a lot of money for hem.

Ok so how about this, if the illustrator had bought a bunch of the dolls and used them as 'reference' for their illustrations, would it still be plagiarism? Or is the kerfuffle merely because the photographs were clearly traced, thereby ripping the photographer's work off? If you own the dolls, is it still ripping off?

- The dolls are original works of art created by small artist groups. If the dolls were only references for poses or lighting, then there wouldn't be a problem. But it's like buying a betty boop doll and making a painting from it and calling it your original design. If she credited the sources, this wouldn't be AS BIG of a problem as it is. The tracing is still low, tho.dechanique

@greedo: yes. her commercial clients, her commercial client´s clients, the buyers of her artwork, all of them can expect unique character design (based on the way she describes and represents her work on various profiles and towards the galleries).
the fact that she based her illustrations on someone elses photos makes it worse, but it´s not the main point. she sampled/ripped someone elses concept to make profit, obviously failed to get permission, then resold these concepts, misrepresented her work.
just not acceptable for the league she´s playing in (venturing into fine art...).

I think we can all agree that the issue is that she co-opted the entire concept of these characters, not necessarily the photography.

If you visit the artist website - http://www.mijnschatje.fr/ what I find very disturbing is the following statements:
