To merge shapes in Photoshop, not raster layers...but merge 2 diff shapes into 1 shape?

I tried coomand e, just rasterizes the shapes

I don't think so, no. Do you mean merge two vector shapes?
You could export as paths to illy, merge them there, then import the new shape as a path.
Thats probably not what you're on about though.

Sort of - select the path you want with the dark path selection tool, copy it, then select the other shape layer and it should paste into it. Keep in mind you can also always click on any path and choose whether it adds, intersects, cuts, etc.

Select both layers (smart objects)
Right click - "Convert to Smart Object"

smart objecting both doesnt do the trick

You need them to exist as paths or shape layers (also paths) first. Then you can merge your various paths together in a few different ways to make them seamless.

hold down the option key then click on the first shape layer, then hold down the shift + option key and click on the second shape layer then make a new layer/path and either fill/create path.

Using the Direct select tool, select one of the shapes that you want to merge and hit Ctrl (Cmd) + C. Then click the vector layer of the shape you want to merge it with and paste the shape into that vector layer. The shape will be pasted right in its place and you can drag it around with the Select tool. You can delete the original layer.
If you shift click both shapes in the layer you'll notice that you have path options in the toolbar to add, subtract, exclude, etc. The paths will still be editable until you click the expand button.
