Timeline!

what exactly happened?? he made some logo work and uploaded to his site so someone else copied it and uploaded to a stock site and now the stock site is asking that he pay for the art he created??
that makes no sense!!

Seems like an odd story to me. What exactly is the stock site billing him for in terms of usage? That he had them displayed on his portfolio? That would be more of a cease/desist issue with the stock company I think, not some gigantic bill.
But even still, this all seems so easily provable that it's his own work if it really is. Between digitally timestamped files and invoices or check copies for work completed, whats all the hub bub.

name and shame.

I understand the guy's concern, but knowing the process - as all of us do - how simple would it be too get an attorney, timeline the creation of each design with each client and counter sue?
If he kept even vague records of his workflow, this sounds like an easy case, right? Am I wrong?

You REALLY need a lawyer, soonest. Once you hire a lawyer, he/she will write a letter to the harassing (scum-bag) lawyer, calling them off of you, and your clients. This will likely cost you $1,000 or so. From there, your lawyer will charge you up to $250 per hour to defend you.
All in all, you may be in the hole $5000 or so. Likely less, however, you will get through this with proper representation.
Then come your counter suit. If you're in the "right", you'll come out with all of your expensed paid off, and then some.
Dude, I still don't quite understand what happened to you based on your post, but wishing you the BEST of luck.

Dam, £18K. I hope he can prove his innocence in court. And that lawyer is out of order contacting his client and informing them of copy right issues, that would be Slander, right.
- jamble0
Sounds like a pretty straightforward case for the designer to defend, I don't really see why there's such an issue.
As mentioned, surely he would be able to easy defend his case in court and should then counter sue for damaged.
Job done.

the way I see it is that the original artist can sue the artist who stole his work and got paid from the stock art website.

^^ Slander, YES. Because NOONE has been proven guilty yet, or, in the wrong. COUNTERSUIT!!!
- OSFA0
See! This is why we need an attorney website just like Crowdspring!
You post your case and have them all fight for your case for $150 once you pick a 'winner'!

This is bullshit.
Document made date proves his innocence. His document would have been made before the items were available on the stock website. Something this simple pretty much goes to show that this story must be fabricated.

Also, a lesson that perhaps using "stock symbols" within original logo ideas/deliverables may not be such a good idea? I know, easy to say after the fact, but, stock is stock is stock, and is likely to show up in other places.
- Did you read the article?.chossy
- He didn't say he did that. He purchased a chef's hat for a "project", not necessarily a logo.harlequino
- GR doesn't read
GR only use his wisdom in the political threadGeorgesII - Sorry, no bad intention here. Yes, I read, but did not fully understand, obviously.GetRefresh

mmm, it's the perfect time to call your hitman. Ask him to break some bones at the beginning.
- benfal990
or ask Mal to ship his bag of skulls to them as a warning.

this is why i don't do anything for anyone I don't personally know. I feel sorry for the guy, I've had my work ripped before and had to sedn out cease and desists letter to them, but to have your work ripped, then have some stock company come back and claim the work as their own and change this guy, WTF?
- uberdesigner0
he should go to law school
- gabe0
i hope the guy's innocent, but something seems fishy about the story...doesn't it?
i would be furious—i mean absolutely livid—if this happened to me. i would be going after stockart like a pitbull, and i wouldn't let it linger for 9 months...especially after they crossed the line and called my clients
