Hey all!
Had my design printed on a shirt but the printers work turns out to be a crap.
I bought blank shirts, brought it to their shop, paid them, came back a week later and the shirt prints have smudges, they used poor paints.
What legal action would you do? How would you compromise. Ive shelled out my hard earned money for the shirts..
Any advice? Anyone?

Non-legal advice: Get them to pay up for the shirts and refund you. If they wont, threaten legal action.
Then get some legal advice.

Yeah, I was assuming you've not signed off anything making you liable for any dumbassedness?

They're more into heat press. But I asked them i they do silkscreen they answered YES..I was asking for samples but they told me they do'nt have stocks..@mojo:
I was thinking of asking them to pay for the shirt..I'll ask again tomorrow..nevermind about the print..I just need the shirts back..
and yes I did signed a received job order..- the fact they didn't have samples should have made you steer clear. still, they should refund the shirt cost or shoot out the smudges if they are small.TREBIO

Blankeycue, I would chalk it up as a lesson learned. Never pay for anything until you have it in front of you and can see its okay. Anyone who wants payment upfront is either going to disappoint you or about to go out of business, there are no other reasons for upfront payment under the circumstances you describe.
I think you'll have a job getting any satisfaction out of pursuing them for refunds now.

I paid a downpayment first...but when I delivered the shirts they ask for a whole payment...they approved the sample print themself without my permission...

if this is in fact true, you may have some leverage to use against them.

Except that you agreed to pay them the balance, thereby declaring, with your cash, that you trust them to approve the work themselves... unless I've misunderstood, but the way I have read it they called you up, said "we're finished, can we have ful payment?" and you said "Depends... do they look okay?" and they said "Yeah,m they look great" and you said "Okay then, if they look great, here's my payment".
If thats the case: I'm not saying you don't have a leg to stand on, but I am saying you've got a fight on your hands to get your money back.

yupp...coz the the personnel/secretary told me that the printer showed print sample to the owner and the owner suggested to fix the color...

thats the ideal process right...but this time they asked for the full payment..no phone calls even SMS...no print sample...I was even the one asking if the shirts are done...

what company did you go with? Sorta sounds familiar like this one place around here.
Anyway, just take shirts back and let them know that you're not leaving with with out getting a refund for the messed up shirts. There is no reason to ever accept shit ink that isn't cured all the way. And if they adjusted the color they might have added too much reducer. good luck.

@szymon_k Actually I didnt take any of it...I told them theyre all rejects..the adjusting of color maybe accepted...but havng smudges..i dont think so..there are even shirts with double prints..meaning they didnt used adhesives..then they rerun the print..i hope you could picture what im describing..

love the fact that you ask for 'legal action' straight away... it's not all about suing people, you know.
just tell them your not happy and you want them to reimburse you for the knackered t-shirts and give you a refund. duh.

i have friends that print shirts in their basement, have the whole pro set up - i can picture your horror.

@Raniator yupp..I cant imagine myself shelling out just for an attys fee..I guess Ill do that...reimburse and refund...

Hey all,
I got an update...they had the printing outsourced.
They admitted that they're more into heat press which we all know sucks on shirts..
The boss went silent..when he admitted..then he started tossing the blame on me...like he was convincing me on the first time I brought my shirts to have it done in digital print(heat press)....
To make the story short I forced them to refund my shirt and my printing..the first 2days was a headache since they don't want to..they told me that they'll have to ask for the printer to pay me. I didn't agree since I was the one talking to them not to the printer..but they gaved in..
But they still convinced me to take some shirts that doesn't look so bad. Since theyll be paying me a big amount. So I did. I know I shouldn't.
So I'm tossing those shirts to some of my friends as giveaway they're all rejects anyways..23pcs of them. Or maybe sell them at a lower price just to cover the expense of the shirt.
So there...

when it comes down to it, i always enjoy screening my own shirts. yes it's time consuming, and pretty tech if you get into more than 2 colours but you know what you are getting. I find it fun, i guess not all people would though.

I know how to silkscreen..but when it gets to 2 or more colors is kinda risky esp if it will be for sale.
