thanks to everyone who helped me with this first crit:

The main headline (over the pic) reads awkwardly in all caps to me.

2nd one is safer but still works.

The second is nice, my only comment is that maybe you'd like to give the nav buttons a little more breathing room between each other, or make then a solid bar, they seem awkwardly cramped to me.

My boss/creative director would go for the first one.
I'd disagree and choose the second one.
I would work with the horizontal divider though. Make it less pixely and even a little wider/taller/bigger.
I would also try to get a bird or part of a bird outside of the blue image and into the white area above (making your coding job harder, i know).
I don't know what color your main content text is, but it needs to be a dark grey or lighter brown, not black or really dark brown. It jumps out too much and takes away from the smoothness of the design.
I think the 'mastheadish' type over the image could use some work. Maybe some size adjustments. If it were mine I would increase both lines and make the top line condensed and taller.
