Have a look at the Graphic Arts Guild Book on Pricing and Ethical Guidelines. They have a good section on dealing with late payment. There is a kind of proper way in terms of submitting letters, calling, a few times and then engaging a lawyer.
But in short, I would say if you havent been paid, then they dont own anything – I am sure your contract stipulates this in some way?
So, take it down.

Perhaps take it down but I would not put up a "pending payment" on there. This is just petty and juvenile.
When I wanted a payment I went over to the office spoke to them FACE TO FACE and waited in the office till a cheque arrived. It took 10mins.

(Feb 28 07, 08:41)I was up 350 Friday. Up 850ish Saturday (I had a brilliant run playing video poker. I hit 4 aces twice for 800 each time. Then I got stupid and started betting on the 5$ machines). Lost 400 Sunday. Came back with more money than I went there with which is nice!

adamm. I freelanced to her and it was a client of her company. That could have been the case if not for her saying quite a few months ago "Don't forget... you work for me not my client" when the client got super pissy about a change I didn't think was right to make and she did.
So, fast forward to now and I don't care if she hasn't gotten paid by them, I work for her not them, so when my work for her is done I get paid.

if you simply just take the site down, replace it with a splash page that says something like 'we are having technical difficulties", something like that, then they really can't shoot on you for anything, and probably would still be willing to work with you in the future (if you wanted to), but trust me I am freelancing again now, and it hurts when people don't pay up. So I hear you man. We may be doing what we love/like, or whatever, but still we gotta eat.
