I know none of you would be so stupid - but I have been - so just a warning that you should always find the source of an image that you use on your websites. I used an image of about 30 x 30 pixels on a clients site. It was maniplated and had a colour overlay. I didnt think anything else of it. I didnt do any check on it and unfortunately the rights were owned by Getty. Now the client is being sued by getty and we in turn are being sued by the client.
Dumbass

how the hell can the client sue you? they gave you the image.
- eu770
nah - they didnt
I really have been stupid. I did their site a few years back when I was bit naive....

Oh.
back to my original statement... "ouch"

Whoa, sorry to hear that.
A lesson learned though.

Is your company being sued, and will you have to pay out of pocket or does the company have to pay? Sorry to hear.
- eu770
im hoping that the company is insured against this type of thing. I wont have to pay for it personally but no doubt I'll have to pay in other ways........i dont mean sexual favours or anything by the way..

damn. sorry to hear about that man.
i noticed a while back my previous employer is using imagery i specifically told them was not ours, and i found out they never bought it.
now i'm afraid if they ever do get caught they're going to come after me as the skapegoat. shit.
hope it works out for you man.

This be an interesting thread to show to those clients who are unwilling to pay for good stock photography and want you to "source it from elsewhere".
- grunttt0
kona - send them an email stating just that - "as I told you previously the 'blank' images are not property of 'blank' company. Just a friendly reminder. blah, blah, blah."
then save and print and file that email somewhere safe.

fuck--I would have thought they would have just issued a cease and desist
was it royalty free, or rights assigned?
- eu770
yeah it was a copyrighted image. A real shit one too.
I took the whole website down as soon as I heard. But apparently its made no difference whatsoeverThe ironic thing is that the client was bought over a couple of months previous and a new site was in the pipeline.

FYI those big ass stock motherfucking agencies can ALWAYS track down photos on the internets..it's weird, but the photos carry some hidden code that's still there even when you manipulate or c/p it.
or so i heard..

Just because you're being sued doesn't mean you're liable necessarily. It wasn't your site.
The situation blows, but your legal liability might not be anything. It depends on your contract.
BTW, we got a subscription to Photos.com for crap stock, cheap and you can do anything you want with the images.
Your client must hate you, it won't be the last.

FYI: They go after the designer and the company equally...happened a few years back to some peeps I know and they had to split it within the lawsuit.
