Logo Fraud

A client of mine has a logo (that he just loves, and it is nice) that he paid someone to design. He's printed cards, I've designed a site around it, etc. Much time and money has gone into using it.
A few weeks ago I was browsing a logo book at a store and damn if it wasn't the exact same logo!! Same letter, same scale - same everything!! Really, anyone would think they were one and the same.
So should I tell him? On one hand he loves it, so whe upset him. I am on good standy with him, but I don't want to upset him (not to mention the site is completely designed around the logo).
On the other, if his business gets really big, who knows. It'd cost a bunch more later on.Thoughts? Oh, and a friend says he saw a similar logo, too, so I doubt that this is the only one resembling the original.
Thanks.

tell your friend its a rip off... people shouldn't have to pay for stolen design.

show us his and the one in the book and let us decide.
If it is a rip off then it's true that he should get his money back.
Imagine if someone ripped off your design. You would want to know!

can you determine which came first?

I would probably tactfully tell him that it's his responsibility to do the research on if the identity his previous designer created is unique and original.
Include in all your agreements that you're using pre-established artwork and cannot be liable for issues of copyright.
Offer to assist with research if he needs it. If he shrugs it off, you're covered, you still have a good site and get paid.
If he doesn't, you'll have to come clean. Sorry, man, that's a tough situation.

show us the logo - NOW DAMMIT

it is possible that the designer of the logo submitted it to the book

I'll have to go back to the book store and hope I can find it again.
No, it's not the same logo in the book. It's from another company, i am sure of that.
Great thought about covering my ass, I never thought of that and it's a reasonable way to approach him.
I honestly think he'd just shrug it off and say he likes it anyway, but who knows. I do know that if he were to scrap it, it'd cost him a ton of cash in prints, marketing, and possibly redesigning the site.
I'll think about posting if I can dig up the other one.
He's not really a 'friend', more of a casaul acquaintance. I am doing the site for almost ZERO (it's a little, but a fraction of what it should be).
Thanks for looking

if Quark can survive with a duplicate, I'm sure your client will be fine.

(Feb 28 06, 11:50)and yes, surely you must have your clients to show? consider it a perception test.

--------------------------------...If you've got a web site that requires being redesigned simply because a logo might change, you've got a much different and bigger problem.

let's see it
and if you remember the other company, can't you dig it up online?

I dont' know the other companies name. I just saw it and thought 'figures, everyone likes the design - no wonder, it's in a book of 'great logos'!'
I'll show if I can find the other logo, but I hate it when people post on here without knowing if it's stolen or not. I want to know for sure before I make any solid accusations.
Thanks for the opinions. if he was a 'friend', I'd tell him, but I don't want to come across as 'telling on someone'.
Honestly, I'd assume he (and most) would rather not know. There's a 99% chance it'll never have an effect on his life.if the logo was just designed, that'd be one thing, but it's been around for at least 2 years, printed in magazines, cards, etc. (His was, don't know about the original)

why don't you atleast post the current logo, and maybe someone will recognize it.

show the damn thing

my Fast wants you to show it to us
